GENERAL PROVISIONS
§ 152.01 PURPOSE.
   The purpose of this chapter is to establish and promote health and safety standards for rental housing and to secure and preserve the integrity and character of residential districts within the city. These standards relate to the condition, maintenance, and occupancy of rental dwelling units and are intended to ensure that rental housing is safe, sanitary, and suitable in accordance with applicable provisions of the State Building Code and other regulations as adopted by the city.

§ 152.02 SCOPE.
   This chapter applies to all rental dwelling units within the city. This chapter shall not apply to owner- occupied dwellings wherein roomers or boarders are maintained in common living areas in accordance with other applicable codes and ordinances. This chapter shall not apply to hotels, motels, dormitories, lodging, and boarding houses and other transient residential occupancies. Buildings housing business or commercial uses in addition to rental dwelling units shall be subject to the provisions of the State Building Code which apply to such mixed uses.

§ 152.03 DEFINITIONS.
   For the purpose of interpreting this chapter, certain words, terms, and expressions are herein defined. Words used in the present tense include the future; the singular number includes the plural, the plural includes the singular; the word SHALL is always mandatory. The words DWELLING, DWELLING UNIT, and PREMISES shall be construed as though they were followed by the words “or any part thereof”.
   APARTMENT. A room or group of rooms intended to be occupied for living persons.
   BOARDING HOUSE. A building under single management renting sleeping accommodations to 15 persons or fewer without individual bathroom or eating facilities.
   CERTIFICATE OF USE AND OCCUPANCY. The certificate issued by the Code Official, which permits the use of a building and which certifies compliance with the provisions of law for the use and occupancy of the building in its several parts together with any special stipulations or conditions.
   CODE OFFICIAL. The officer or other designated authority charged with the administration and enforcement of the Building Code of the City of Weston or a duly authorized representative.
   DORMITORY. A building under single management renting sleeping accommodations to more than 15 persons without individual bathroom or eating facilities.
   DWELLING. Any house, building, or mobile home intended to be occupied as the place of habitation of human beings on a permanent basis.
   DWELLING UNIT. A single unit providing complete, independent living facilities for one or more persons, including permanent provisions for living, sleeping, eating, cooking, and sanitation.
   HOTEL. A building under single management in which more than 15 rooms are rented providing sleeping accommodations for transients with or without meals, having an annual turnover of room occupancy exceeding 300% in which the rooms are not directly accessible from an outdoor parking area.
   LANDLORD. The owner of a building, including one or more dwelling units.
   LODGING HOUSE. The same as BOARDING HOUSE.
   MOTEL. An establishment under single management which provides lodging and parking for transients and in which the rooms are so designed to provide accessibility from an outdoor parking area and having an annual turnover of room occupancy exceeding 300%.
   OCCUPANT. Any person living, sleeping, cooking or eating in, or having actual possession of a dwelling unit.
   OPERATOR. Any person, including the owner, who has charge, care, or control of a building, including one or more dwelling units.
   OWNER.
      (1)   Any person who alone, jointly, or as tenant in common with others, has legal or equitable title to any dwelling unit with or without accompanying actual possession thereof.
      (2)   For the purposes of this subchapter, OWNER includes an agent of the owner empowered by the owner to act on the conditions or under the circumstances in question.
   OWNER-OCCUPIED DWELLING. Any townhouse, condominium, or detached dwelling that is occupied as a dwelling by the owner.
   PERSON. A natural person, his or her heirs, executors, administrators, or assigns and also a firm, partnership, or corporation and its, or their, successors or assigns.
   PREMISES. A parcel or lot of land and its buildings or other improvements.
   RENT. To grant the possession and enjoyment of premises, dwelling, or dwelling unit in return for the payment of money, goods, labor, service, or otherwise from the tenant for the use of the premises, dwelling, or dwelling unit.
   RENTAL DWELLING UNIT. Any dwelling unit which is offered in whole or part for residential purposes and for which remuneration is received.
   TENANT. An occupant of a rental dwelling unit who has signed a lease or made a verbal contract exceeding a seven consecutive day commitment.
   TRANSIENT. An individual who rents sleeping, living, and sanitary facilities on a daily or weekly basis.
