§ 90.99 PENALTY.
   (A)   Any person violating any provisions of this chapter for which no other penalty is provided shall be subject to the provisions of § 10.99.
   (B)   It shall be unlawful for any person to fail to obey the provisions of § 90.26 and, upon the conviction of a violation hereof, shall be fined not less than $20, nor more than $100, or other amount deemed appropriate by the Municipal Court.
   (C)   (1)   Except as otherwise expressly provided herein or as otherwise expressly mandated by state statute, the commission of a first violation of any provision of §§ 90.40 to 90.47 shall be considered a misdemeanor offense and shall, upon conviction thereof, result in the assessment by the Municipal Court Judge of fine in an amount not exceeding $25, or other amount deemed appropriate by the Municipal Court, plus all costs of the proceeding, including any costs assessed by the County Animal Shelter.
      (2)   Except as otherwise expressly provided herein, the commission of a second violation of any provision of §§ 90.40 to 90.47 shall be considered a misdemeanor offense and shall, upon conviction thereof, result in the assessment by the Municipal Court Judge of a fine in an amount not less than $50 nor more than $100, or other amount deemed appropriate by the Municipal Court, plus all costs of the proceedings, including any costs assessed by the County Animal Shelter.
      (3)   Except as otherwise expressly provided herein, the commission of a third violation of any provision of §§ 90.40 to 90.47 shall be considered a misdemeanor offense and shall, upon conviction thereof, result in the assessment by the Municipal Court Judge of a fine in an amount not less than $100, nor more than $500, or other amount deemed appropriate by the Municipal Court, plus all costs of the proceedings, including any costs assessed by the County Animal Shelter. Any person upon conviction of a third offense by the Municipal Court Judge or subsequent violation of any provision of §§ 90.40 to 90.47 may be ordered to be confined for a period not exceeding 30 days.
   (D)   (1)   Upon a first conviction pursuant to § 90.63(A), in addition to all costs for impoundment, the owner shall be punished by a fine of $250; upon conviction of a second offense within 24 months of any prior conviction, in addition to all costs for impoundment, the owner shall be punished by a fine of $500; or other amounts deemed appropriate by the Municipal Court; and said dog shall be euthanized.
      (2)   Upon conviction pursuant to § 90.63(B), in addition to all reasonable costs of impoundment, the owner shall be punished by a fine of $500, or other amount deemed appropriate by the Municipal Court.
      (3)   Upon conviction pursuant to § 90.63(C), in addition to all reasonable costs of impoundment, the owner shall be punished by a fine of $250, or other amount deemed appropriate by the Municipal Court.
   (E)   The Municipal Court Judge shall have the authority to order any such person convicted of violating § 90.64 to pay a fine of not more than $500, or other amount deemed appropriate by the Municipal Court.
   (F)   (1)   Any person found guilty of an aggressive dog at large, as described in § 90.65, shall be punished by a fine as follows, or in other amounts deemed appropriate by the Municipal Court:
         (a)   For the first offense within a 24-month period: $60;
         (b)   For the second offense within a 24-month period: $80;
         (c)   For the third offense within a 24-month period: $120;
         (d)   For the fourth offense within a 24-month period: $200; and
         (e)   For a fifth or subsequent offense within a 24-month period: $500.
      (2)   The Municipal Court Judge shall have no authority to suspend the fine; provided that with regard to a fifth or subsequent offense within a 24-month period, the Municipal Court Judge shall have the authority to reduce the fine to an amount no less than $250, or other amount deemed appropriate by the Municipal Court, if the defendant agrees to forfeit ownership of the animal. In such cases, all interest of the animal shall vest to the human association for appropriate disposition. All fines arising from convictions for violations of § 90.65 shall be in addition to any applicable court costs or impoundment fees.
   (G)   The owner of any impounded dog, as described in § 90.66, shall pay a fee of $10 per day for each day a dog is impounded, plus a fee of:
       (1)   For the first impoundment: $25;
      (2)   For a second impoundment: $50;
      (3)   For a third impoundment: $75;
      (4)   For a fourth impoundment: $100;
      (5)   For a fifth or any subsequent impoundment: $150; or
      (6)   Other amounts deemed appropriate by the Municipal Court.
