This subchapter regulates the use of external solid fuel-fired heating devices designed so that usable heat is derived for the interior of a building. A building permit is required for any external solid fuel-fired heating device or external storage unit. All outdoor external solid fuel-fired heating devices are subject to public nuisance. The exhaust stacks or chimneys must be constructed according to the manufacturers specifications and must be a minimum of 25 feet above ground level, and must be masonry or insulated metal with a minimum 6 inch internal flue diameter. Only clean fuel solids may be burned, or stored for burning in the device.

For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
CLEAN FUEL SOLIDS. Natural dry wood, corn, or pellets which have not been painted, varnished, stained, or coated with a similar material, have not been treated with preservatives and does not contain any resins or glues as in plywood, particle board, or other wood composites.
EXTERNAL SOLID FUEL-FIRED HEATING DEVICE. An appliance installed out of doors and designed to transfer or provide heat, via liquid, steam, or other means, through the burning of clean fuel solids for heating purposes. Also known as “outdoor wood-fired hydronic heaters” and “outdoor wood-fired boilers”.
PUBLIC NUISANCE. As defined in § 92.15 of The Wells City Code of Ordinances.

(A) This subchapter does not apply to grilling or cooking food using charcoal, wood, propane or natural gas in cooking or grilling appliances.
(B) This subchapter does not apply to burning for the purpose of generating heat in a stove, furnace, fireplace or other heating device within a building used for human or animal habitation.
(C) This subchapter does not apply to the use of propane, acetylene, natural gas, gasoline, kerosene, or fuel oil in a device intended for heating, construction or maintenance activities.
(D) This subchapter does not apply to campfires, a small outdoor fire intended for recreation or cooking.

Any person, firm, or corporation, or other entity who shall violate any of the provisions of §§ 94.10 through 94.12 or who shall fail to comply with any of the provisions of §§ 94.10 through 94.12 or who shall make any false statement in any document required to be submitted under the provisions of §§ 94.10 through 94.12 shall be guilty of a misdemeanor and, upon conviction thereof shall be punished by a fine not to exceed $1,000 or by imprisonment not to exceed 90 days. Each day that a violation continues shall constitute a separate offense.
