§ 94.01  FIRE LIMITS.
   (A)   All that part of the City of Wells lying within the area described in this section shall be designated as and shall constitute the fire limits of the City of Wells, Faribault County, Minnesota, to-wit:  commencing at the intersection of the center line of Second Avenue Northwest with the center line of Minnesota Trunk Highway 109 and running thence easterly and southeasterly along the center line of the Minnesota Trunk Highway 109 to its intersection with the easterly corporate limits of the City of Wells, Minnesota, thence south to the center line of Third Street Southeast, thence west along the center line of Third Street Southeast to the center line of Second Avenue Southwest, thence north along the center line of the Second Avenue to the point of beginning.

   (B)   No building shall hereafter be erected, enlarged, repaired, improved or placed within the boundaries of the fire limit until a permit for the erection, enlarging, repairing, improving, or placing thereof shall have first been obtained from the City Council of the City of Wells, Faribault County, Minnesota.
   (C)   (1)   No building or structure of any kind or description shall be erected, constructed, or placed within the fire limits as defined in division (A) above, or as the same may be hereafter defined, unless the building or structure shall be constructed in the manner following, to-wit:  The outside or party walls thereof shall be not less than 8 inches thick and shall be composed of brick or stone, and all walls excepting front and rear walls and the inside walls of every second building or structure shall extend through and at least 15 inches above the roof, provided that buildings erected and used as dwellings only may be constructed with walls 8 inches in thickness and the walls thereof shall not be required to extend above the roof.  All cornices hereafter constructed or placed upon buildings within the fire limits shall be constructed of brick, stone, or metal.
      (2)   All chimneys hereafter erected within the fire limits shall be built to a height of at least 4 feet above the roof, and shall be composed of brick and shall not be less than 4 inches thick.  The roof of every building hereafter erected within the fire limits shall be composed of slate, metal, or other non-combustible material.
   (D)   There shall be annually appointed in the month of March by the City Council of the City of Wells, 1 person as Fire Chief who shall receive the compensation as shall be fixed by the City Council; the Fire Chief to hold office for the term of 1 year and until his or her successor is elected and qualified.
   (E)   The Fire Chief shall before entering upon the duties of his or her office make oath for the faithful performance of the duties of his or her office and shall also make and file a bond with sufficient sureties to be approved by the City Administrator-Clerk-Treasurer of the City of Wells in the sum of $1,000 conditioned for the faithful performance of the duties of his or her office as required by this section.
