Pursuant to Iowa Code, chapter 137, the city council may, by agreement, contract public health matters to county boards of health. It is therefore hereby established that the Black Hawk County health department be, by agreement, designated as the entity acting as the city's board of health. The Black Hawk County health department is specifically responsible for the enforcement of the following provisions of this code:

A. Enforcement Authority: Pursuant to Iowa Code chapter 170A, the director of the department of inspections and appeals or the chief inspector of the inspections division of the department of inspections and appeals of the state of Iowa shall have the authority to enforce all provisions of the Iowa food service sanitation code within the corporate limits of the city unless an agreement has been entered into with the local board of health pursuant to Iowa Code section 170A.4.
B. Testing: Sample testing of food or milk products shall be performed, as provided by the laws of this city and state, in a certified lab or in the city's testing lab. A fee established by resolution of the city council shall be charged for each sample taken and processed. (Ord. 3672, 10-16-1989)
