351.99 PENALTY.
   (a)   In addition to any other manner of enforcement provided for in this Traffic Code, any person who violates Sections 351.02, 351.04, 351.05(a), 351.07, 351.08, 351.09, 351.11, 351.13 or 351.19 is guilty of a first degree misdemeanor and shall be fined thirty five dollars ($35.00) provided such fine is paid within forty-eight hours from the time of citation; fifty dollars ($50.00) if such fine is paid subsequent to forty-eight hours from the time of citation and within seventy-two hours from the time of citation and seventy five dollars ($75.00) if such fine is paid subsequent to seventy-two hours from the time of citation and within thirty days from the time of citation. However, if such fine is not paid within thirty days from the time of citation, the penalty set forth in Section 303.99 shall apply to any such violation.
   (b)   In addition to any other manner of enforcement provided for in this Traffic Code, any person who violates Sections 351.10, 351.13 or 351.18 is guilty of a first degree misdemeanor and shall be fined fifty dollars ($50.00) provided such fine is paid within forty-eight hours from the time of citation; seventy five dollars ($75.00) if such fine is paid subsequent to forty-eight hours from the time of citation and within seventy-two hours from the time of citation and one hundred dollars ($100.00) if such fine is paid subsequent to seventy-two hours from the time of citation and within thirty days from the time of citation. However, if such fine is not paid within thirty days from the time of citation, the penalty set forth in Section 303.99 shall apply to any such violation.
   (c)   Whoever violates Section 351.20 is guilty of a minor misdemeanor and shall be fined thirty dollars ($30.00) provided such fine is paid within forty-eight hours from the time of citation; forty dollars ($40.00) if such fine is paid subsequent to forty-eight hours from the time of citation and within seventy-two hours from the time of citation; and fifty dollars ($50.00) if such fine is paid subsequent to seventy-two hours from the time of citation and within thirty days from the time of citation. However, if such fine is not paid within thirty days from the time of citation, the penalty set forth in Section 303.99 (b) (1) shall apply to any such violation. Any person who violates Section 351.20 shall also be assessed any costs incurred by the Municipality in disposing of such vehicle or abandoned junk motor vehicle, less any money accruing to the Municipality from such disposal.
   (d)   The penalty for Section 351.05 (a), (c), (f) and (h) shall be as follows:
      (1)   Whoever violates Section 351.05(a) or (c) is guilty of a minor misdemeanor and shall be fined thirty dollars ($30.00) provided such fine is paid within forty-eight hours from the time of citation; forty dollars ($40.00) if such fine is paid subsequent to forty-eight hours from the time of citation and within seventy-two hours from the time of citation; and fifty dollars ($50.00) if such fine is paid subsequent to seventy-two hours from the time of citation and within thirty days from the time of citation. However, if such fine is not paid within thirty days from the time of citation, the penalty set forth in Section 303.99 (b) (1) shall apply to any such violation.
      (2)   Whoever violates Section 351.05(F)(1) A. or B. is guilty of a third degree misdemeanor and shall be fined two hundred fifty dollars ($250.00) provided such fine is paid within forty-eight hours from the time of citation; two hundred seventy five dollars ($275.00) if such fine is paid subsequent to forty-eight hours from the time of citation and within seventy-two hours from the time of citation and three hundred dollars ($300.00) if such fine is paid subsequent to seventy-two hours from the time of citation. In no case shall an offender who violates Section 351.05(F)(1) A. or B. be sentenced to any term of imprisonment. Whoever violates Section 351.05(F)(1) A. or B. shall be fined fifty dollars ($50.00) provided such fine is paid within forty-eight hours from the time of citation; seventy five dollars ($75.00) if such fine is paid subsequent to forty-eight hours from the time of citation and within seventy-two hours from the time of citation and one hundred dollars ($100.00) if such fine is paid subsequent to seventy-two hours from the time of citation if the offender, prior to sentencing, proves either of the following:
         A.    At the time of the violation of Section 351.05(F)(1) A., the offender or the person for whose transport the motor vehicle was being operated had been issued a removable windshield placard that then was valid or special license plates that then were valid but the offender or the person neglected to display the placard or license plates as described in Section 351.05(F)(1) A.
         B.    At the time of the violation of Section 351.05(F)(1) B., the offender or the person for whose transport the motor vehicle was being operated had been issued a parking card that then was valid or special handicapped license plates that then were valid but the offender or the person neglected to display the card or license plates as described in Section 351.05(F)(1) B.
      (3)    The clerk of the court shall pay every fine collected under subsection (c) of this section to the Municipality. The Municipality shall use the fine moneys it receives under subsection (d)(2) of this Section to pay the expenses it incurs in complying with the signage and notice requirements contained in 351.05(e). The political subdivision may use up to fifty per cent (50%) of each fine it receives under subsection (d)(2) of this Section to pay the costs of educational, advocacy, support, and assistive technology programs for persons with disabilities, and for public improvements within the political subdivision that benefit or assist persons with disabilities, if governmental agencies or nonprofit organizations offer the programs.cfr
      (4)    Whoever violates Section 351.05(h) shall be punished as follows:
         A.    Except as otherwise provided in subsection (d) (4) of this Section, the offender shall be issued a warning for the first offense.
         B.    If the offender previously has been convicted of or pleaded guilty to a violation of Section 351.05(h) or a section of the Ohio Revised Code that this similar to that Section, the offender shall not be issued a warning but, for each parking location that is not properly marked or whose markings are not properly maintained, shall be guilty of a minor misdemeanor and fined twenty five dollars ($25.00).
   (e)   In addition to any other manner of enforcement provided for in this Traffic Code, any person who violates Section 351.22 is guilty of a first degree misdemeanor and shall be fined one hundred dollars ($100.00). However, if such fine is not paid within thirty days from the time of citation, the penalty set forth in Section 303.99 shall apply to any such violation.
     (f)   In addition to any other manner of enforcement provided for in this Traffic Code and unless no other penalty is given, any person who violates any provision of this chapter other than those Sections listed in subsections (a), (b), (c), (d) and (e) above, shall be guilty of a first degree misdemeanor and fined thirty dollars ($30.00) provided such fine is paid within forty-eight hours from the time of citation; forty dollars ($40.00) if such fine is paid subsequent to forty-eight hours from the time of citation and within seventy-two hours from the time of citation and fifty dollars ($50.00) if such fine is paid subsequent to seventy-two hours from the time of citation and within thirty days from the time of citation. However, if such fine is not paid within thirty days from the time of citation, the penalty set forth in Section 303.99 shall apply to any such violation.
