§ 4-401 DEFINITIONS.
   For the purpose of this article, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ELECTRICAL CONTRACTOR. Any person engaged in the business of installing or repairing electrical wiring and who is qualified, or employs master electricians who are qualified to serve the public in the installation, repairing, re-wiring and maintenance of electrical wiring.
   ELECTRICAL WIRING. The installation, repairs, connection, alteration or replacement of wiring in buildings and structures for the use of electrical current for electric fixtures, appliances, motors or other apparatus.
   JOURNEYMAN ELECTRICIAN. Any person who holds a legal certificate showing that he or she is qualified to do electrical wiring under the direction and supervision of a certified master electrician.
   MASTER ELECTRICIAN. A person who is qualified, certified and equipped to properly layout, plan, make any installation, repair or maintenance of electrical wiring, appliances, fixtures, motors and other apparatus requiring electrical current, and who is or works under the employment of an electrical contractor.

§ 4-402 ADOPTION OF ELECTRICAL CODE.
   There is hereby incorporated by reference for the purpose of establishing standards for the protection of the public health, safety and welfare within the corporate limits of the City of Wamego, Kansas, that certain electrical code known as the National Electrical Code (NFPA 70), 2017 Edition, including Annex A, B, C, D, E, F, G, H and I, a standard of the National Fire Protection Association, One Batterymarch Park, Quincy, Massachusetts, 02169, save and except such articles, sections, parts or portions as may be hereinafter omitted, deleted, modified or changed. No fewer than one copy of such publication shall be marked or stamped “Official Copy as adopted by Ord. 1629”, and shall be attached to a copy of this ordinance and filed with the City Clerk and open for inspection and available to the public at all reasonable hours. All administrative departments of the city charged with enforcement of this code shall be supplied, at the cost of the city, such number of official copies, similarly marked, as may be deemed expedient.

§ 4-403 SAME; AMENDMENTS.
   The National Electrical Code, adopted by § 4-402 is hereby changed, altered, modified and otherwise amended as follows:
   (a)   Article 210.8(A)(2) of the National Electrical Code is hereby changed to read as follows:
Article 210.8(A)(2) Dwelling Units. All 125 volt, single phase, 15 or 20 ampere receptacles installed in garages and grade level portions of unfinished accessory buildings used for storage or work areas shall have ground fault circuit interrupter protection for personnel.
Exceptions:
   1.   Receptacles that are not readily accessible.
   2.   A single receptacle or duplex receptacle located within dedicated space for each appliance that in normal use is not easily moved from one place to another, and that is cord and plug connected.
   (b)   Article 210.8(B)(2) of the National Electrical Code is hereby changed to read as follows:
Article 210.8(B)(2) Other Than Dwelling Units. All receptacles that are readily accessible and do not serve a dedicated appliance.
   (c)   Article 210.12 of the National Electrical Code is hereby changed to read as follows:
Article 210.12 Arc Fault Circuit Interrupter Protection.
   a.   Definition. An arc-fault circuit interrupter is a device intended to provide protection from the effects of arc faults by recognizing characteristics unique to arcing and by functioning to de-energize the circuit when an arc fault is detected.
   b.   Dwelling Unit Bedrooms. All branch circuits that supply 125 volt, single phase, 15 and 20 ampere receptacle outlets installed in dwelling unit bedrooms shall be protected by an arc-fault circuit interrupter(s) of the combination type.
   (d)   Article 210.52(1) of the National Electrical Code is hereby deleted.
   (e)   Article 230.70 (A) of the National Electrical Code is hereby amended to read as follows:
Article 230.70 (A) Location. The service disconnecting means shall be installed either inside or outside of a building or structure at a readily accessible location nearest the point of entrance of the service conductors.
Service disconnecting means shall not be installed in bathrooms.
Additionally, an outside service disconnect shall be required when either of the following conditions exist:
   a.   The distance from the electric meter base to the service panel exceeds eight (8) lineal feet.
   b.   The distance from the entrance point of the service conductors to the service panel exceeds three (3) lineal feet.
   (f)   Article 300.5(C) of the National Electrical Code is hereby amended to read as follows:
Article 300.5(C) Underground Cables Under Buildings. Underground cable installed under a building shall be in a raceway installed under a building shall be in a raceway.
   (g)   Article 334.10 of the National Electrical Code is hereby amended to read as follows:
Article 334.10 Uses Permitted. Type NM, Type NMC, and Type NMS cables shall be permitted to be used in the following:
   1.   One and two family dwellings.
   2.   Multi-family dwellings permitted to be of Type III, IV and V construction.
   A)   Type NM. Type NM cable shall be permitted as follows:
      (1)   For both exposed and concealed work in normally dry locations except as prohibited in Section 334.10(3).
      (2)   To be installed or fished in air voids in masonry block or tile walls.
   B)   Type NMC. Type NMC cable shall be permitted as follows:
      (1)   For both exposed or concealed work in dry, moist, damp or corrosive locations, except as prohibited by 334.10(3).
      (2)   In outside and inside walls of masonry block or tile.
   (3)   In a shallow chase in masonry, concrete or adobe protected against nails or screws by a steel plate at least 1/16 inch thick and covered with plaster, adobe or similar finish.
   C)   Type NMS. Type NMS cable shall be permitted as follows:
      (1)   For both exposed and concealed work in normally dry locations except as prohibited by 334.10(3).
      (2)   To be installed or fished in air voids in masonry block or tile walls.
   (h)   Article 334.12 of the National Electrical Code is hereby amended to read as follows:
Article 334.12 Uses Not Permitted.
   A)   Types NM, NMC and NMS. Types NM, NMC and NMS cables shall not permitted as follows:
   (1)   In any structure not specifically permitted in 334.10(1) and
   (2)   As a service entrance cable.
   (3)   In hoistways or on elevators or escalators.
   (4)   Embedded in poured concrete or aggregate.
   B)   Types NM and NMS. Type NM and NMS cables shall not be used under the following conditions or in the following locations.
   (1)   Where exposed to corrosive fumes or vapors.
   (2)   Where embedded in masonry, concrete, adobe, fill or plaster.
   (3)   In a shallow chase in masonry, concrete, or adobe and covered with plaster, adobe or similar finish.
   (4)   Where exposed or subject to excessive moisture or dampness.
   (i)   Articles 406.4(D)(4), 406.4(D)(5) and 406.4(D)(6) of the National Electrical Code are hereby deleted.
   (j)   Article 406.9(B)(1) of the National Electrical code is hereby amended to read as follows:
Article 406.9(B)(1) 15 and 20 Ampere Receptacles in a Wet Location. 15 and 20 ampere, 125 and 250 volt receptacles installed in a wet location shall have an enclosure for the receptacle that is weatherproof when the receptacle is covered (attachment plug cap not inserted and receptacle covers closed). All 15 and 20 ampere 125 and 250 volt non locking type receptacles shall be listed weather resistant type.

§ 4-404 RULES AND REGULATIONS PERTAINING TO NEW ELECTRIC WIRING AND CONNECTIONS.
   (a)   At a minimum, a two-inch rigid conduit shall be required for an entrance mast, when extended through the roof.
   (b)   All electrical wiring in a commercial building shall be in rigid conduit, electrical metallic tubing, metal molding, or flexible conduit.

§ 4-405 SAME; FEE.
   The fee for an electric permit to install electric conductors and equipment as regulated by the National Electrical Code, adopted under § 4-402 of this article, shall be $35. Such fee is payable at the time the application is submitted for the electric permit, and the same shall be credited to the General Operating Fund of the city.

§ 4-406 ELECTRICAL REINSPECTION FEE.
   (a)   All work done in violation of this article is subject to reinspection by the City Building Official until such work is approved and found to be in compliance with the National Electrical Code and other applicable city regulations.
   (b)   All reinspections required after the time period set by the Building Official to correct the work found to be in violation shall be subject to a $50 reinspection fee to be paid to the city, and credited to the General Fund of the city.
