A. A certain document, one (1) copy of which is on file in the Office of the Codes Enforcement Officer of the City of Vinita, Oklahoma, being marked and designated as the International Building Code, 2015 edition, or most current edition thereafter, and as hereafter amended from time to time, including appendix chapters C through H, as published by the International Code Council, be and is hereby adopted as the Building Code of the City of Vinita, in the State of Oklahoma, for regulating and governing the conditions and maintenance of all property, buildings and structures; and each and all of the regulations, provisions, penalties, conditions and terms of said Building Code on file in the Office of the Codes Enforcement Officer of the City of Vinita are hereby referred to, adopted, and made a part hereof, as if fully set forth in this section, with the additions, insertions, deletions and changes, if any, prescribed in subsection B of this section. A. Fire Limits Defined: All parts of the incorporated City within the following limits shall hereafter be known as the fire limits of the City:
Beginning at the intersection of the center of North Second Street and the center of East Flint Avenue in the City of Vinita, Oklahoma, thence due west along the center line of West Flint Street to the intersection of the center line of North Foreman Street, thence south along the center line of North Foreman and South Foreman Street to the intersection of the center line of West Illinois Avenue, thence due east along the center line of West Illinois Avenue to the alleyway in the center of Block 50 in the City of Vinita, Oklahoma, between Lots 4 and 5, thence south along the center line of said alleyway to the intersection of the center line of West Canadian Avenue, thence east along the center line of West Canadian Avenue to the intersection of the center line of South Scraper Street, thence south along the center line of South Scraper Street to the intersection of the center line of South Avenue, thence east along the center line of South Avenue to the intersection of the center line of the alleyway running between Block 72 and 73 in the City of Vinita, Oklahoma, thence north along the center line of said alleyway to the intersection of the center line of East Canadian Avenue, thence east along the center line of East Canadian Avenue to the intersection of the center line of South Vann Street, thence north along the center line of South Vann Street to the intersection with the center line of the northern most alleyway running east and west through Block 48 in the City of Vinita, Oklahoma, thence due east parallel to the center line of Illinois Avenue to the intersection of the center line of South Second Street, thence north along the center line of South Second Street to the point of beginning.

B. Construction Regulations:
1. No person, firm or corporation shall hereafter erect any building or any addition to any building or structure within the fire limits unless the outer walls, ground floor and covering thereof be composed wholly of noncombustible materials; provided however, that wood flooring may be laid over noncombustible underflooring with the screeds embedded in the noncombustible underflooring, so that the wooden flooring shall at all points be in direct contact and touch with the underflooring.
2. Nothing herein, however, shall be understood to prohibit the use of tar and gravel or slag and asbestos roofing, but such roofs must be approved by the building inspector.
3. All exposed windows within the fire limits except windows facing on streets, alleys or yards over thirty feet (30') wide shall be protected by standard fire resisting shutters or by metal window frames and metal sash, glazed with wire glass, such shutters in all cases to be made from noncombustible materials and to be self-enclosing and automatic, as approved by the National Board of Fire Underwriters.
4. In all buildings, structures and additions within the said fire limits over fifty feet (50') wide, which have divided partitions supporting the roof or the floor above, the dividing partitions shall be of noncombustible material. If beams or girders and posts and piers are used in lieu of partitions, same shall be of noncombustible material.
5. No part of any building shall extend beyond the building line and on streets, except windows, cornices and galleries above the first story or ten feet (10') in the clear above grade line, and such projection beyond the building line shall not exceed three feet (3'); provided however, that in no case shall any building or any part of a building extend beyond the street line, excepting that anywhere above the second story, the main roof cornice may project twenty four inches (24"), and all minor cornices and belts, twelve inches (12"); and on buildings of five (5) stories and more, the main roof cornice may project not more than forty inches (40") beyond the property line bordering on a street or alley. C. Taller Buildings Fireproofed: All buildings, structures or additions in the fire limits three (3) or more stories in height shall be fireproof in construction. All stairways, floors, walls, partitions, beams, girders, columns and supports shall be noncombustible material. The top hand mold or railing may be of wood, but the newels shall be noncombustible. A. Permit Required; Capping Of Sewer Line:
1. It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, move or demolish any building or any other structure in the city without first obtaining a building permit for each building or structure from the building inspector of the city.
2. No building permit shall be issued under this section until, and unless, prior to the issuance of said building permit, the codes enforcement officer has certified that the building permit applicant has capped the sewer line in such a manner as to prevent any infiltration into the sewer system. The sewer line capping shall occur at the city main unless good cause is shown why the line should be capped elsewhere. (Ord. 2959, 7-21-1992)
B. Issuance Of Permits: The codes enforcement officer is hereby appointed building inspector as additional duties to his office and shall issue permits for the erecting, constructing, enlarging, altering, repairing, improving, moving or demolishing of any building or structure within the city, upon payment of the prescribed fee as hereinafter set forth upon application to his office. C. Permit Fee; Bond:
1. The codes enforcement officer shall charge a fee for each permit issued by his office for erecting, constructing, enlarging, altering, repairing, improving, moving or demolishing any building or structure within the city, and any additional administrative fee authorized by law. The city shall additionally collect any fees required by the Oklahoma uniform building code commission or other state agency and shall remit such fees to the appropriate entity pursuant to state law. 2. Further, any applicants seeking to move, or causing to be moved, any building shall deposit a bond with sufficient sureties to be approved by the codes enforcement officer in the amount of one thousand dollars ($1,000.00), providing for payment of all damages that may be sustained by virtue of the moving operations. The person moving a building shall place and maintain danger lights about the building sufficient to warn other persons using the streets and alleys.
3. It shall be unlawful for any person, firm, corporation, partnership or individual to move or cause to be moved any house or building, or part thereof, or similar structure, on the streets or alleys of the city without having first obtained such permit, paid such permit fee, and deposited such bond with the codes enforcement officer.
