§ 36.59 TEMPORARY EMPLOYEES.
   (A)   The employment of as many additional temporary employees as necessary in the Service Department of the City of Van Wert, Ohio, be and hereby is authorized.
   (B)   Employees classified as temporary employees shall receive a wage determined by the Safety-Service Director; unless filling the duties of a job classification on the schedule adopted in § 36.08(A), then the wage shall be determined by the schedule adopted in § 36.08(B).
   (C)   Said duly authorized job classification of temporary employees shall not qualify the person so employed for said job classification for any fringe benefits to which full-time employees are entitled, excluding sick leave.

§ 36.60 VACATION LEAVE.
   (A)   Vacation leave.
      (1)   Each employee of the Service Department shall be entitled to vacation leave beginning January 1 of each year as follows:
 
Less than 1 year
Pro-rated
Over 1 but less than 8 years
2 weeks
Over 8 but less than 15 years
3 weeks
Over 15 but less than 22 years
4 weeks
Over 22 years
5 weeks
 
      (2)   Vacation for non-bargaining unit employees shall be based on time in the employee’s respective retirement system.
      (3)   A maximum of 1 week of unused vacation can be carried over to the following year, provided that no employee shall have available more than the current year’s accrual of vacation plus 1 week.
      (4)   Vacation policies are governed by the Personnel Policy and Procedure manual for the city.
   (B)   Vacation for retired rehired employees.
      (1)   Any employee returning to work after retiring will not receive vacation immediately and will have to start over under the 2 week per year vacation accrual rate. Once the first year is complete they will be eligible to use vacation. This is exactly the same as a new employee. The complete description for vacation can be found in the Policy and Procedure Manual.
      (2)   The rehired employee will be given up to 25 days of personal leave at the time of hire. This time off can be used anytime in the year and is not subject to carry-over. This benefit is at the discretion of the Mayor and Safety-Service Director.
      (3)   Individuals not subject to retire/rehire may be granted up to 25 personal days at their time of hire based on experience and education. This benefit is at the discretion of the Mayor and Safety-Service Director.
      (4)   Personal leave will be reduced each year as additional vacation time is earned.

§ 36.61 SICK LEAVE.
   (A)   The Personnel Policy and Procedure Manual governs the sick leave policy.
   (B)   Each employee who has accumulated 1,000+ hours of accrued but unused sick leave on his date of retirement, retires after 10 or more years of service with the city and gives 1 year or more written notice of retirement shall receive payment for 500 hours of accrued but unused sick leave.
   (C)   Those employees who fail to provide the 1 year written notice or have accrued less than 1,000 hours of unused sick leave on his date of retirement will be paid for 25% of the value of the employee’s accrued but unused sick leave, up to a maximum payment of 240 hours.
   (D)   All payments for qualifying payout settlement items (vacation, sick leave upon retirement, personal days, comp time, holidays earned, etc.) shall be based on the employee’s base pay at the time of resignation, termination or retirement.

§ 36.62 INSURANCE PROVISIONS.
   (A)   Any full-time employee covered by this subchapter shall receive hospitalization and medical insurance. Family coverage shall be provided where appropriate.
   (B)   Any full-time employee shall receive a life insurance policy on the employee’s life in the face value equivalent to the employee’s annual salary, rounded off to the next higher $1,000 with a maximum $50,000 face value.

§ 36.63 IMMUNIZATION FOR COMMUNICABLE DISEASES.
   City employees shall be reimbursed for medical costs incurred for immunizations necessitated by exposure to communicable diseases while acting in the line of duty.

§ 36.64 RESPONSIBILITY FOR ADMINISTRATION.
   The Mayor and Safety-Service Director shall be responsible for salary administration for all job classifications as set forth in this subchapter and shall be responsible for salary administration for all employees on an equitable basis.

§ 36.65 INTERPRETATION.
   The Mayor and Safety-Service Director shall be responsible for interpreting the application of this subchapter in those situations not specifically covered, using the principles expressed herein as a policy guide.

§ 36.66 REVIEW AND AMENDMENT.
   Prior to the annual submission of the permanent budget to City Council, the Safety-Service Director shall complete a review of this subchapter and submit the Safety-Service Director’s findings together with the recommended amendments to the Mayor for the Mayor’s presentation to the City Council.

MUNICIPAL COURT
§ 36.70 SCOPE.
   This subchapter is intended to cover the following:
   (A)   Regular job classifications, salary ranges, and hourly pay for all full-time, non-elective employees of the Van Wert Municipal Court.
   (B)   Methods of placing individuals within their regular pay ranges for their jobs.
   (C)   Maximum number of employees authorized for each job classification.
   (D)   Work day, week and overtime compensation.
   (E)   Accrual of sick leave.
   (F)   Establishment of a holiday schedule.
   (G)   Establishment of a vacation schedule.
   (H)   Special allowances for specific classifications.
   (I)   Administration of the job classification and pay schedule.
   (J)   Hospitalization insurance with prescription coverage and life insurance benefits.

§ 36.71 AUTHORIZED PERSONNEL; JOB CLASSIFICATION AND PAY.
   A maximum number of employees, their titles, job classifications and pay ranges shall be provided in:
   (A)   The schedule adopted in § 36.08(A), which specifies the maximum number of employees in each job classification.
   (B)   The schedule adopted in § 36.08(B), which establishes the pay range for each authorized classification.

§ 36.72 PLACEMENT; APPROVAL.
   Placement within each pay range is recommended by the Chief of the department, based upon the employee’s experience, length of service, qualifications and job performance, subject to the approval(s) outlined below:

§ 36.73 HOLIDAYS.
   (A)   All employees in the Municipal Court who are classified and considered full-time employees shall receive their regular rate of compensation for the following days as holiday pay.
      (1)   New Year’s Day.
      (2)   Martin Luther King Jr. Day.
      (3)   President’s Day.
      (4)   Good Friday (4 hours).
      (5)   Memorial Day.
      (6)   Juneteenth Day.
      (7)   Independence Day.
      (8)   Labor Day.
      (9)   Columbus Day.
      (10)   Veteran’s Day.
      (11)   Thanksgiving Day.
      (12)   Day after Thanksgiving.
      (13)   Christmas Eve (4 hours).
      (14)   Christmas Day.
      (15)   New Year’s Eve (4 hours).
      (16)   Two personal days.
   (B)   Any holiday leave time not used by December 31 of each year shall be forfeited.
   (C)   Personal days may be used at the discretion of the employee after receiving prior approval from the Clerk, Court Administrator, or Judge.
   (D)   The holiday shall be considered the day upon which said holiday is celebrated, if not celebrated on the calendar day upon which it falls. Should the paid holiday fall on a Saturday or Sunday, the preceding Friday or the following Monday shall be given off unless another date is designated by the Judge.

§ 36.74 STANDARD WORK DAY, WORK WEEK AND OVERTIME.
   (A)   The standard work hours per day and/or week for the Court and all its employees shall be 8 hours per day, 40 hours per week.
   (B)   The hourly rate shall be calculated as follows for eligible employees:
      (1)   Annual salary divided by total number of annual work hours.
   (C)   Overtime for eligible employees shall be 1½ times the employee's hourly rate.
