No person utilizing a compactor collection vehicle (contractor) shall collect commercial or residential solid waste, including curb collection, within the Municipality other than as follows:
(a) All residential garbage and rubbish shall be collected from residences once each week. A special collection between January 2 and January 15 of each year shall be held for collection of Christmas trees unless this requirement is waived by the City Manager.
(b) No collection of residential garbage, rubbish or discarded goods shall begin before 7:00 a.m. or continue after 6:00 p.m. without approval of the City Manager.
(c) The Contractor is responsible for scheduling collection days and is responsible for making the collections on such days. Any subsequent changes in the collection schedule shall be noted by publication of the notice in a newspaper of general circulation throughout the City, by mail or by hand delivery, to each residential unit.
(d) No collection shall be made on any Sunday, or Christmas Day, New Years Day, Memorial Day, Labor or Thanksgiving Day. If collections are not made on any holiday, the Contractor shall catch up with the regular schedule within five working days.
(e) It shall be the duty of the Contractor to give advance notice of collection days and of any subsequent change in schedules by either publication of such notice at least twice in a newspaper of general circulation, by mail or by hand delivery to each residence. (Ord. 956. Passed 1-19-93.)
In addition to all other requirements:
(a) All solid wastes, while awaiting collection, shall be stored in such a manner that they do not constitute a fire, health, or safety hazard or provide food or harborage for vectors, and shall be contained or bundled so as not to result in spillage. When containers for residential garbage are not at the curb for collection, they shall be stored in the garage of the residential structure or at the rear of the residential structure adjacent to the structure. All solid waste containing food wastes shall be securely stored in covered or closed containers which are non-absorbent leakproof, durable, easily cleanable, if reusable, and destined for safe handing. Containers shall be of an adequate size and in sufficient numbers to contain all food wastes, rubbish, and ashes that a residence or other establishment generates in the period of time between collections. Containers shall be maintained in a clean condition so that they do not constitute a nuisance, and to retard the harborage, feeding and breeding of vectors. When serviced, storage containers should be emptied completely of all solid waste.

(b) Storage of bulky wastes while awaiting collection shall include, but is not limited to removing all doors from large household appliances and covering the item(s) to reduce the problems of an attractive nuisance, and the accumulation of solid waste and water in and around the bulky item(s).
(c) All storage of commercial solid waste and containers while awaiting collection, not located within a fully enclosed building or structure, shall be completely enclosed by a solid wall, solid fence and solid gate not less than six feet in height.
(d) No owner or person in possession or in charge of any premises located within the Municipality shall maintain or permit the storage thereon of any solid wastes except while awaiting the next regular periodic collection and then only in accordance with the provisions of the Codified Ordinances, nor shall such owner or person fail to provide for the collection of solid wastes as provided by the Codified Ordinances.
(e) All recyclable materials while waiting collection, shall be stored in such a manner that they do not constitute a fire, health or safety hazard or provide food or harborage for vectors, and shall be contained so as not to result in spillage. All recyclable materials shall be cleaned and rinsed and put in a 20-gallon container for recyclable or co-mingled materials that is the official recycling container as designated by the City.
It shall be the duty of each person to insure that yard rubbish is not placed in solid waste or the recycling container that is set out for curb-side collection.
(1) Bags specifically designated for yard rubbish purchased from the refuse hauler at a cost not to exceed the yard bag rate set by Council, per Section 741.17 and the refuse hauler may contract with anybody to supply yard bags.
(2) The refuse hauler may refuse collection of any yard waste not disposed of in the manner prescribed in this section.
(3) The refuse hauler may refuse collection of any otherwise acceptable residential solid waste where the approved container also contains yard rubbish.
(4) The refuse hauler may refuse collection of any yard bag which contains material which is not yard waste.

(a) Reusable waste containers and recycling containers shall be constructed of corrosion resistant metal or other materials which will not absorb water, grease or oil. The containers shall be leakproof, including sides, seams and bottoms and be durable enough to withstand anticipated usage without rusting, cracking or deforming in a manner that would impair servicability. The interior of the container shall be smooth without interior projections or rough seams which would make it difficult to clean or interfere with its emptying. The exterior of the container should be safe for handling with no cracks, holes or jagged edges. Containers should be stored on a firm, level, well drained surface which is large enough to accommodate all of the containers and which is maintained in a clean spillage-free condition.
(b) Reusable waste containers which are emptied manually shall have a capacity of no more than thirty-five gallons (132.5L) in volume, and reusable recycling containers which are emptied manually shall have a capacity of no more than 20 gallons in volume, and shall not exceed seventy-five pounds (34.05 kg) when filled, unless they are mounted on casters and can be serviced by being rolled to the collection vehicle and tilted for emptying. The containers shall be constructed with rounded edges and tapered sides with the larger diameter at the top of the container to facilitate discharge of the solid waste by gravity. Containers shall have two handles or bails located directly opposite one another on the sides of the container. Containers shall have covers which are tight-fitting to resist the intrusion of water and vectors, and should be equipped with a suitable handle. Containers shall be designed so that they cannot be tipped over easily, and shall be capable of being serviced without the collector coming into physical contact with the solid waste.

(c) Reusable waste containers which are emptied mechanically shall be designed or equipped to prevent spillage or leakage during onsite storage, collection or transport. The container shall be easily cleanable and designed to allow easy access for depositing the waste and removing it by gravity or by mechanical means. The containers shall be easily accessible to the collection vehicle in an area which can safely accommodate the dimensions and weight of the vehicle.
(d) Single-use plastic and paper bags shall meet the National Sanitation Foundation Standard No. 31 for polyethylene refuse bags and Standard No. 32 for paper refuse bags, respectively. However, such bags do not need to have been certified by the National Sanitation Foundation. Single-use bags containing food wastes shall be stored within the confines of a building or container between collection periods. (Ord. 790. Passed 5-26-87.)
(a) All vehicles used for the collection and transportation of solid wastes and recycling materials shall be enclosed or adequate provisions shall be made for suitable cover, so that while in transit there can be no spillage.
(b) The equipment used in the compaction, collection and transportation of solid waste and recycling materials shall be constructed, operated and maintained in such a manner as to minimize health and safety hazards to solid waste management personnel and the public. This equipment shall be maintained in good condition and kept clean to prevent the propagation or attraction of vectors and the creation of nuisances.

(a) The minimum collection frequency consistent with public health and safety shall be adopted to minimize collection costs and fuel consumption. In establishing collection frequencies, generation rates, waste composition and storage capacity shall be taken into consideration. (Ord. 790. Passed 5-26-87.)
(b) In all instances, solid wastes and recycling materials shall be collected with frequency sufficient to inhibit the propagation or attraction of vectors and the creation of nuisances. Solid wastes which contain food wastes shall be collected at a minimum of once during each week. Bulky wastes shall be collected at a minimum of once every three months.

The collection of solid wastes and recycling materials shall be conducted in a safe, efficient manner, strictly obeying all applicable traffic and other laws. The collection vehicle operator shall be responsible for immediately cleaning up all spillage caused by his operations, for protecting private and public property from damage resulting from his operations, and for creating no undue disturbance of the peace and quiet in residential areas in and through which he operates.

Containers for all residential garbage and residential rubbish and recycling materials shall be placed at the street curb or alley right-of -way line not sooner than twelve hours before the beginning of the day of normal collection thereof. For the purposes hereof, the beginning of the collection day shall be considered to be at 7:00 a.m. (Ord. 881. Passed 2-6-90.)
