715.06. Limitation on dredging operations; restricted areas.
   Except upon special permit issued by the Commissioner of Inspection, as hereinafter provided, commercial dredging operations in the Toledo Harbor are hereby limited and prohibited as follows:
   (a)   On Sundays on the west side of the Maumee River from the 3200 block to the 3700 block of West River Road.
   (b)   On the west side of the Maumee River above Corbett Island before 8:00 a.m. and after 5:00 p.m. of each day.
   (c)   Within 100 feet on each side of the twenty-four inch water main (extending from the west side pumping station to Rossford) crossing the Maumee River in the vicinity of Corbett Island.
   (d)   Within 100 feet of the northwest shore and within 200 feet of the southeast shore of Clark Island.
   (e)   Within 100 feet of any shore of Delaware and Horseshoe Island.
   (f)   Within 100 feet of the west shore of the Maumee River from Walbridge Park to the upriver City limits.
   (g)   Within 200 feet of the South End Bridge.

715.07. Special permit for dredging in restricted areas.
   Special permits for commercial dredging in restricted areas shall be issued to licensees under this section by the Commissioner of Inspection upon recommendation of the Commissioner of Streets, Bridges and Harbor and approval of the Director of Public Service. Requests for such permits shall be submitted to such Commissioner of Streets, Bridges and Harbor with suitable drawings giving details of requested operations and the time estimated as necessary to accomplish the same and, upon favorable recommendation by such Commissioner of Streets, Bridges and Harbor, shall be submitted to the Director of Public Service for his approval or rejection.

715.08. Reports to Commissioner of Streets, Bridges and Harbor.
   Licensees hereunder shall furnish to the Commissioner of Streets, Bridges and Harbor at the time of their submission to the State of Ohio and the U.S. Corps of Engineers, copies of all requests for permits to dredge in the Toledo Harbor together with copies of tonnage reports of sand and gravel dredged from such Harbor.

715.09. Scope.
   The provisions of this chapter shall not be construed to apply to dredging operations of the United States Government, the State of Ohio, the County of Lucas, the City of Toledo or any other branch of government.

715.99. Penalty.
   Whoever violates any provision of this chapter is guilty of a misdemeanor of the third degree.
