(a) No person shall ride or propel a bicycle owned by a City resident on any street or public way or upon any part thereof unless such bicycle has been provided with a proper evidence of licensing in the prescribed form.
(b) Application for a license and license tag shall be made to the City Administrator or his designated agent by the owner or owner's representative upon a prescribed form. The license issuer may require such proof of ownership or purchase as is reasonable.
(Ord. 98-17. Passed 4-6-98.)
The Chief of Police shall inspect each bicycle presented to him for licensing, and shall have the authority to refuse to approve the application for a license and license tag for any bicycle found by him to be in an unsafe mechanical condition. An appeal from the decision of the Chief of Police to the Mayor may be had by any applicant who is dissatisfied with the decision of the Chief of Police, within ten days from and after such decision.
The Chief of Police shall have the authority to issue, upon written application, bicycle licenses and license tags which shall be effective until surrendered as provided in this chapter. The Chief of Police shall keep a record of the issuance of such licenses and license tags, to whom issued, the number thereof, and the number and make of the bicycle frame. The Chief of Police shall keep a record of all fees collected for the issuance of such licenses and license tags.
Within ten days of the sale or transfer of ownership of a bicycle licensed under provisions of this chapter, the new owner shall obtain a new license and license tag in accordance with this chapter. The new license tag shall be affixed over the former tag, as provided in Section 373.17.
(Ord. 98-17. Passed 4-6-98.)
Upon the issuance of a license, the licensee shall affix the license tag furnished by the City to the frame of the bicycle, under the seat and toward the front of the bicycle. The license tag shall not be obstructed by any accessories or devices. Removal of any such tag by any person, except by proper legal authority or upon transfer of ownership, shall be a violation of this chapter.
(Ord. 84-33. Passed 5-7-84.)
A second or successive violation of provisions of this chapter shall be sufficient cause for the revocation of the license and the license tag. The owner of such bicycle, if an adult, shall be served with written notice of intention to revoke the license tag and such owner or the parent or legal guardian of owner who is a minor may demand a hearing on the proposed revocation. The hearing may be conducted by the Chief of Police or by his designated agent who may be a police officer of the rank of Lieutenant or Captain. If the owner or the parent or guardian of a minor owner demands a hearing in Municipal Court, such shall be in writing and accompanied by a fee prescribed by the Court for such hearing. The determination by the Municipal Court shall be final.
