Except as otherwise provided herein:
(a) Penalties for violation of this chapter shall be as prescribed in Section 303.99 by determining that such violations are a minor misdemeanor.
(b) The penalties herewith adopted shall apply to bicycle owners or operators who are adults. Where the violation is charged to a minor, the penalties shall be as follows:
(1) For the first violation within a period of one year penalty may be impoundment of the bicycle for a period of up to ten days, in which case verbal or written notice shall be given to the custodial parent or guardian of the minor. For the second and subsequent offenses within one year, the penalty may be impoundment up to thirty days and/or revocation of the license.
(2) Further, for second and subsequent violations the custodial parent or guardian shall be presumed to be the owner of the bicycle and responsible for the acts of the minor and may by citation be liable for the offense upon trial in Tiffin Municipal Court.
(3) The Court may in its discretion assess a penalty against the custodial parent or guardian as a minor misdemeanor, or order impoundment of the bicycle for a period not to exceed ninety days or revocation of license or any combination thereof.
