§ 1044.33 SURCHARGE REVIEW AND REVISION.
   The rates of surcharge shall be reviewed and calculated annually in accordance with the federally approved user charge system by the Approving Authority in order to determine whether or not they are sufficient to defray the fixed charges, amortization costs and annual cost of operation as determined from the sewage treatment plant records. If the difference between the revenue derived from the rates of surcharge and the total annual cost is sufficient to justify an increase or decrease in the rates, the Approving Authority shall make the appropriate change. The rates of surcharge shall be as set forth in § 1046.04 of this chapter.

BILLING PRACTICE
§ 1044.34 QUARTERLY BILLING.
   Industrial waste surcharges provided for in this chapter shall be billed by the city as a separate charge over and above the regular bill for sewer charges and shall be payable in four quarterly payments each year.

§ 1044.35 PAYMENT; EFFECTIVE DATE; LATE CHARGE.
   The industrial waste surcharge levied shall take effect on July 1, 1970, and shall thereafter be billed on the first day of each calendar quarter, or as soon in such calendar quarter as billing data become available, and shall be payable at the office of the Director of Finance within 30 days after billing. In case of failure to pay any bill for the surcharge when due, a penalty of 10% of such charge shall be added to the bill.

ENFORCEMENT
§ 1044.353 ENFORCEMENT RESPONSE PLANS.
   The Authority shall develop and implement an enforcement response plan. This plan shall contain detailed procedures indicating how the Authority will investigate and respond to instances of industrial user noncompliance. The plan shall include:
   (a)   Describe how the Authority will investigate instances of noncompliance;
   (b)   Describe the types of escalating enforcement responses the Authority will take in response to all anticipated types of industrial user violations and the time periods within which responses will take place;
   (c)   Identify (by title) the official(s) responsible for each type of response; and
   (d)   Adequately reflect the authority’s primary responsibility to enforce all applicable pretreatment requirements and standards, as detailed in 40 C.F.R. Parts 403.8 (f)(1) and (f)(2).

§ 1044.355 DISCHARGE APPLICATION.
   (a)   When requested by the Director, a user must submit information regarding the nature of their business activity, the characteristics and flow of its wastewater and other information deemed necessary by the Director.
   (b)   The Director is authorized to prepare a form for this purpose and may periodically require users to update this information.
      (1)   The Authority may sample and analyze the effluent from users and conduct inspection and/or surveillance activities to verify information provided by the user.
      (2)   The user shall be responsible for the charges for sampling and analysis as outlined in Chapter 1046.
