INDUSTRIAL WASTE SURCHARGES
§ 1044.31 SURCHARGE REGULATIONS.
   (a)   Normal concentrations. All persons discharging industrial waste into the public sewers shall be subjected to a surcharge, in addition to any other sewer-service charges, if these wastes have a concentration greater than the following normal concentrations:
      (1)   A five-day, 20°C biochemical oxygen demand (BOD) concentration of 250 parts per 1,000,000;
      (2)   A suspended solids concentration of 300 parts per 1,000,000;
      (3)   A phosphorous (measured as P) concentration of 20 parts per 1,000,000;
      (4)   An ammonia (measured as N) concentration of 15 parts per 1,000,000; or
      (5)   An oil and grease (hexane extractable or suitable alternative solvent) concentration of 100 parts per 1,000,000.

   (b)   Items contained in surcharge. The amount of surcharge shall reflect the cost incurred by the city in removing the excess biochemical oxygen demand (BOD), suspended solids, phosphates, ammonia, and oil and grease of the waste load. This surcharge may include a proportionate share of the following:
      (1)   Fixed charges and amortization costs for the sewage disposal works based upon an average useful life of 25 years and an annual interest rate of 5% and under the assumption that the capital investment will be retired at a uniform rate throughout the life of the facilities. Such basis of fixed charges shall be recalculated each five years or at the end of major construction periods, whichever is shorter; and
      (2)   The annual cost of operation of the sewage treatment plants, including repairs and maintenance and the cost of administering this chapter.

§ 1044.32 SURCHARGE COMPUTATION.
   The surcharge per person shall be determined as follows. The excessive pounds of biochemical oxygen demand (BOD), suspended solids, phosphates, ammonia, and oil and grease will be computed by multiplying the person’s sewage flow volume in 1,000,000 gallons per day by the constant 8.345 and then multiplying this product by the difference between the person’s concentrations of biochemical oxygen demand (BOD), suspended solids, phosphates, ammonia, and oil and grease and the aforementioned normal concentrations in § 1044.31(a) of this chapter in parts per 1,000,000 by weight. The surcharge for each constituent will then be determined by multiplying the excess pounds of each constituent by the appropriate rate of surcharge listed in § 1046.04 of this chapter. This product will then be multiplied by the number of days in the billing period to determine the surcharge. Concentration figures in the above calculations shall be daily averages determined in accordance with the provisions of § 1044.18 through 1044.305 of this chapter.

§ 1044.33 SURCHARGE REVIEW AND REVISION.
   The rates of surcharge shall be reviewed and calculated annually in accordance with the federally approved user charge system by the Approving Authority in order to determine whether or not they are sufficient to defray the fixed charges, amortization costs and annual cost of operation as determined from the sewage treatment plant records. If the difference between the revenue derived from the rates of surcharge and the total annual cost is sufficient to justify an increase or decrease in the rates, the Approving Authority shall make the appropriate change. The rates of surcharge shall be as set forth in § 1046.04 of this chapter.

BILLING PRACTICE
§ 1044.34 QUARTERLY BILLING.
   Industrial waste surcharges provided for in this chapter shall be billed by the city as a separate charge over and above the regular bill for sewer charges and shall be payable in four quarterly payments each year.

§ 1044.35 PAYMENT; EFFECTIVE DATE; LATE CHARGE.
   The industrial waste surcharge levied shall take effect on July 1, 1970, and shall thereafter be billed on the first day of each calendar quarter, or as soon in such calendar quarter as billing data become available, and shall be payable at the office of the Director of Finance within 30 days after billing. In case of failure to pay any bill for the surcharge when due, a penalty of 10% of such charge shall be added to the bill.
