§ 1026.01 INSPECTION AND STANDARDS BY CITY ENGINEER.
   The City Engineer or their duly authorized representative may, from time to time, inspect the sidewalks, driveway aprons and tree lawns within the city to determine whether it is necessary to construct, grade, repair or replace such sidewalks, driveway aprons or tree lawns. The City Engineer shall prescribe, in conformity with § 1026.04, standards and specifications for new construction, as well as for reconstruction, grading, repairing or replacing such sidewalks, driveway aprons and tree lawn areas.

§ 1026.02 REPAIR BY CITY; EXTENT OF CITY PARTICIPATION.
   (a)   The city will participate in sidewalk repairs throughout the city based on sidewalk complaints received by the city or as determined by the City Engineer, up to an amount of funds budgeted for that purpose in the calendar year in which the repair is being undertaken. The level of funds to be allocated towards sidewalk repairs shall be an amount as determined by City Council on an annual basis. The city will participate in sidewalk repairs that:
      (1)   Meet the conditions of deteriorated or defective sidewalks in conformance with § 1026.04;
      (2)   Are not part of the property owner’s driveway; and
      (3)   Are not damaged as a result of an act on the part of the property owner.
   (b)   The city shall also pay the cost of replacing handicap ramps at roadway intersections in accordance with standards and specifications prescribed and on file in the office of the City Engineer. If funds are not budgeted for sidewalk repairs in any given year, this section of the Codified Ordinances of the city shall be null and void as if it never existed and all other sections of Chapter 1026 shall apply.
