Whenever the Building Inspector determines that any utility service constitutes or materially contributes to any hazard to persons, health, property, or public welfare, he may order the service to be disconnected to the extent necessary to eliminate the hazard.

Failure by the Building Inspector to observe or recognize any hazardous condition or to deny a permit where any such condition exists or may be created by the work so authorized shall not relieve the owner or person or corporation in possession of any property from his or its responsibility for any such condition or damages resulting therefrom or resulting from any condition created by work performed on the property pursuant to any permit, and shall not create in the city, its officers, agents, or employees, any responsibility for any such conditions or damages.

Appeals from any decision or action of the Building Inspector in the administration or enforcement of the provisions of this chapter may be taken to the Board of Zoning Appeals and the Board shall have the authority to permit, on appeal in any given case, methods, standards, or materials other than those required by this chapter if in its opinion strict compliance with the provisions of this chapter is unnecessary in the case, provided the deviant methods, standards, or materials so permitted are consistent with the objectives of this chapter.

(A) Whoever violates or fails to comply with any provision of this chapter and for which no other penalty is provided is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, such person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense such person is guilty of a misdemeanor of the third degree. Each day's violation shall constitute a separate offense.
(B) In the event of any violation or failure by a corporation, the violation or failure shall be deemed equally committed by the president of the corporation, who shall be, in such an event, deemed personally amenable to the provisions of this chapter and subject to fine hereunder by reason of the violation or failure.
