16-2-2: LICENSE REQUIRED; APPLICATION; INVESTIGATION:
   A.   License Required; Application: It shall be unlawful for any person to act as a driver or operator of a taxicab, automobile, or other motor vehicle which is used in the transportation of passengers for hire within the city without having a license issued by the city clerk, such license to be applied for in writing on such forms as the city clerk may prescribe. Such application shall include:
      1.   Name, age, sex, weight, height, color of eyes and hair of applicant, his residence or address, and length of residence in the city; and place or places of residence and employment during the past three (3) years.
      2.   Whether or not the applicant is now or has been heretofore licensed as a taxicab driver and, if so, as to when and in what state, and whether such license has been revoked or suspended and, if so, the date of such revocation or suspension; the name of the person by whom the applicant is employed.
      3.   The number of times and places arrested or convicted for traffic violations.
      4.   Whether or not the applicant has ever been convicted of a felony or misdemeanor, giving particulars of each conviction.
      5.   Each applicant shall furnish a copy of a valid driver's license issued by the state of Oklahoma. (Ord. 1078, 3-11-2008, eff. 4-10-2008)
      6.   A current Oklahoma state bureau of investigation background check must be attached to the application.
   B.   Investigation Of Facts Of Application:
      1.   The chief of police or other proper officer shall read all pertinent application paperwork within forty eight (48) hours of the time of such receipt. A report thereon, favorable or otherwise, shall be made within five (5) working days after receiving the application or copy thereof.
      2.   If, as a result of such investigations, the applicant is found to be unsatisfactory, the chief of police shall so endorse on the application and return it to the city clerk's office, and no license shall be issued.
      3.   If, as a result of such investigation, the applicant is found to be satisfactory, the chief of police shall so endorse on the application and return it to the community development office, and the license shall then be issued contingent upon applicant meeting all other requirements.    C.   Disapproval; Time Limit To Reapply: In the event any applicant is disapproved by the chief of police because the chief of police finds such applicant unfit by reason of his general reputation for integrity or responsibility, the applicant shall not be eligible to apply for a license until six (6) months thereafter.
   D.   License Refused; Fee Retained: The application shall be submitted to the city clerk and shall be accompanied by the payment of an investigation fee of twenty five dollars ($25.00). In the event the applicant is refused a license, such fee shall be retained by the city.
   E.   Appeal: Any applicant whose application is denied shall have the right to appeal to the city council by making a written request for the city council, and the appeal is to be heard at the next regularly scheduled council meeting.
