10-4-2: POSSESSION OR SALE OF ALCOHOLIC BEVERAGES:
   A.   Possession Or Transportation:
      1.   It is unlawful for any person under the age of twenty one (21) years to be in possession of any alcoholic beverage or low point beer while such person is upon any public street, road or highway or in any public place within the city limits, or to have in possession or under control any alcoholic beverage or low point beer except as provided by law.
      2.   It is unlawful for any parent or guardian of a person under the age of twenty one (21) years to be in possession of any low point beer, except that such a person gaining possession of the beverage from his parent is exempt from this subsection.
      3.   It is unlawful for any person to knowingly transport in any moving vehicle upon a public highway, street or alley any alcoholic beverage or low point beer except in the original container which shall not have been opened and from which the original cap or seal shall not have been removed unless the opened container be in the rear trunk or rear compartment. The rear trunk or compartment shall include the spare tire compartment in a station wagon or panel truck or any outside compartment which is not accessible to the driver or any other person in the vehicle while it is in motion.
      4.   It is unlawful to consume or to carry alcoholic beverages or low point beer while upon the streets, alleys, sidewalks, public ways and parking lots within the city limits, including consumption or carrying of such beverages while in a vehicle, unless the original container shall not have been opened, and the seal upon the original container has not been broken, and the original cap or cork shall not have been removed. Excepted from this subsection are persons who have been given permission by the owner of a private parking lot within the city limits to consume or to carry the beverages on his property.
      5.   For the purpose of this subsection, alcoholic beverage and low point beer shall be as defined by 37 Oklahoma Statutes. (2000 Code § 10-402; amd. Ord. 1074, 3-11-2008, eff. 4-10-2008)
   B.   Intoxicating Liquor And Low Point Beer: It is unlawful:
      1.   For any person to barter, sell, give away or otherwise furnish to another any alcoholic beverage or low point beer of any kind except as permitted by law;
      2.   To have in possession or under control any alcoholic beverage or low point beer except as permitted by law, or to transport or in any manner convey from place to place in the city any alcoholic beverage or low point beer except as permitted by law;
      3.   To loiter in a place where alcoholic beverages or low point beer are sold, bartered, given away or otherwise furnished contrary to law; or
      4.   To keep, maintain, aid or abet in keeping or maintaining a place where alcoholic beverages or low point beer are sold, bartered, given away or otherwise furnished in violation of law. (2000 Code § 10-403; amd. Ord. 1074, 3-11-2008, eff. 4-10-2008)
