9-8-2: PERMIT FEE; NUMBER RESTRICTED; REVOCATION; REFUSAL:
   A.   Permit And Fee Requirements: There is hereby imposed a residential sales fee in the sum of five dollars ($5.00) per occasion on any person engaged in a residential sale. A permit shall be issued by, and the fee collected by, the city water office, or other department designated by the city manager. Permits shall be obtained at least twenty four (24) hours prior to any residential sale. In the event a residential sales permit is not obtained in a timely manner, a permit may be issued by the licensing authority on or after the day of the sale for good cause, in the amount of twenty dollars ($20.00). The residential sales fee may be modified as required by resolution adopted by the city council.
   B.   Time Limit; Number Restricted: No person shall hold, conduct, engage in or participate in any manner or allow a residential sale to be held or conducted on premises under his control or ownership more than three (3) times, lasting more than three (3) days per occasion, within a twelve (12) month period of time.
   C.   Revocation: Any permit issued under this chapter may be revoked or any application for issuance of a permit may be refused by the city clerk if the application submitted by the applicant or permit holder contains any false, fraudulent or misleading information.
   D.   Refusal: If any person is convicted of an offense under this chapter, the city clerk is instructed to cancel any existing residential sale permit held by the person so convicted and not to issue such person another residential sale permit for a period of two (2) years from the date of conviction.
