The following hazardous substance releases are not considered violations of the terms of this chapter:
A. The release or emission of hazardous materials shall be permitted when in compliance with federal, state, and local governmental agencies, regulations or permits.
B. The release of pesticides is permitted when utilized according to registered label directions unless otherwise regulated in this code.
C. The release of fertilizer and soil improvement materials shall be permitted when performed according to manufacturer's specifications. (2000 Code § 8-705)
