A. Permit Required: It shall be unlawful for any individual or entity to install, construct, or replace any fiber optic line, equipment or other infrastructure that utilize the easements and public rights-of-way without obtaining a permit pursuant to the requirements of this chapter. This shall specifically exclude and not apply to wireless services.
B. Additional Permits: The license requirement set forth in this chapter shall be in addition to, and not in lieu of, any other licensing and permitting requirements imposed by any other federal, state or local law.
C. Licensing fees inapplicable. It is recogni7ed that municipal licensing requirements have been preempted by state and federal law. Nothing herein shall be construed to require a municipal license to operate or provide telecommunications services within city limits, less and except what may be applicable under an exclusive franchise agreement.
