In the event that a responsible party discharges pollutants which causes the city to violate any conditions of its UPDES permit or otherwise violate any applicable law, rule or regulation, and the city is found to be liable for such discharges of pollutants (including civil or administrative fines, penalties or other charges), then the responsible party shall be fully liable to the total amount of such liability (including civil or administrative fines and penalties) incurred by or otherwise assessed against the city, including administrative costs incurred.
