Where persons are obliged to convey water across lands lying between their premises and the public irrigation waterway, the conveyance shall be done with the least possible injury to property, both in constructing the necessary ditches and in managing the water flowing therein, and such person shall be liable for all damages caused by negligence in the construction of such ditches or in the management of water flowing therein.
