57-8-5: FRANCHISES:
   A.   When Franchise Agreement: Any company paying Franchise Taxes to the City shall not be required to pay additional annual fees for encroachments within the parameters of the franchise agreement.
   B.   Outside Franchise Agreements: Encroachments by such companies outside of franchise agreements shall be handled in separate written agreements and shall be subject to:
      1.   The provisions of section 57-8-4 of this chapter; or
      2.   Fees based on a percentage of gross receipts. (2019 Compilation)
