3-1-1: DEFINITIONS:
For the purposes of this chapter, the following terms, phrases, words, and their derivations shall have the meanings given herein:
GARBAGE: Waste foodstuffs or table wastes of vegetable or animal origin, together with other incidental admixtures.
REFUSE: Shall include all inorganic matter such as tin cans, glass, paper, ashes, sweepings, leaves, grass, etc. Stones, sod, earth, concrete, contractors' building materials, large automobile parts, large appliances, inflammable liquids, tree trunk sections over four inches (4") in diameter, animal wastes, except when adequately wrapped, or articles so heavy or bulky that they cannot be easily lifted by one person shall not be considered "refuse". 3-1-2: GARBAGE DISPOSAL REQUIRED; FREQUENCY; USE OF CITY SYSTEM:
It shall be unlawful for any person, firm or corporation not to dispose of garbage and refuse which accumulates upon their property at least once a week. Every householder, occupant and owner of any dwelling, boarding house, apartment building, or any other structure utilized for dwelling purposes shall use the garbage and refuse collection system as provided by the city. 3-1-3: CONTAINER SPECIFICATIONS:
   A.   Every householder, occupant and owner of any dwelling, boarding house, apartment building, or any other structure utilized for dwelling purposes, and any restaurant, industrial or commercial establishment that accumulates garbage shall provide one or more flytight metal garbage containers of thirty (30) or thirty two (32) gallons' capacity to contain all garbage which accumulates between collections. Metal garbage containers of less capacity now in use may continue to be used until they become unserviceable. Also, plastic bags of sufficient strength to prevent tearing of the bag or loss of the garbage or refuse therefrom may be used. No such container shall weigh in excess of seventy five (75) pounds when full.
   B.   All apartment buildings containing four (4) or more units, and each commercial establishment, industrial establishment, or restaurant where garbage accumulates and the volume exceeds four (4) 30-gallon or 32-gallon containers per week shall use vat service with pick up of no less than once per week. The actual size of the vat and frequency of service is to be based on need as determined by the city code enforcement officer. Vats shall be of no less than one cubic yard capacity and designed with the proper attachments for lifting into refuse trucks. (Ord. 18, 5-16-1972)
3-1-4: USE OF CONTAINERS; PREPARATION AND PLACEMENT FOR PICK UP:
All accumulations of garbage must be put in the containers as provided herein. Tree limbs under four inches (4") in diameter and in three foot (3') lengths, tied in bundles, leaves, grass, or other refuse in waterproof bags, magazines tied securely and weighing less than twenty (20) pounds, and Christmas trees up to six feet (6') in length shall be placed on pick up day next to the alley or at the curb line. 3-1-5: COLLECTION OF GARBAGE AND REFUSE:
All garbage and refuse accumulated in the city shall be collected, conveyed and disposed of under supervision of the city council. The council shall have the authority to make rules and regulations concerning days of collection, type and location of waste containers and such other matters as deemed necessary; provided, that such are not contrary to the provisions of this chapter. 3-1-6: NOTICE TO COMMENCE OR DISCONTINUE SERVICE:
It shall be the responsibility of every resident to notify the city at least one week in advance of starting or discontinuing service. (Ord. 18, 5-16-1972)
3-1-7: FEES FOR COLLECTION AND DISPOSAL; BILLS FOR SERVICE; DELINQUENCIES:
   A.   Composition Of Fees; Bills; Delinquencies: The fees for collection and disposal of garbage and refuse for all residential users shall be as determined by contract with the city, plus a reasonable amount for administrative expense. The city shall compute the amount due the city for garbage and refuse collection and render a statement thereof to each residential user. All amounts due hereunder shall be payable at the office of the city clerk-treasurer on the tenth of the month in which the statement is presented. A penalty of ten percent (10%) shall be added to all bills not paid by the date fixed for final payment, and collection may be stopped without notice. (Ord. 18, 5-16-1972)
   B.   Fees Established: Garbage and refuse collection fees shall be established by resolution of the city council. (2005 Code)
