A. Composition Of Fees; Bills; Delinquencies: The fees for collection and disposal of garbage and refuse for all residential users shall be as determined by contract with the city, plus a reasonable amount for administrative expense. The city shall compute the amount due the city for garbage and refuse collection and render a statement thereof to each residential user. All amounts due hereunder shall be payable at the office of the city clerk-treasurer on the tenth of the month in which the statement is presented. A penalty of ten percent (10%) shall be added to all bills not paid by the date fixed for final payment, and collection may be stopped without notice. (Ord. 18, 5-16-1972)
B. Fees Established: Garbage and refuse collection fees shall be established by resolution of the city council. (2005 Code)
Persons accumulating garbage or refuse shall comply with the following requirements:
A. Unlawful Disposal: No person shall place any garbage or refuse in any street, alley or other public place, or upon any private property, whether owned by such person or not, unless it be in proper containers for collection or under express approval granted by the council; nor shall any person throw or deposit any refuse in any stream or other body of water.
B. Scattering Of Garbage And Refuse: No person shall cast, place, sweep or deposit any garbage or refuse in such a manner that it may be carried or deposited by the elements off his property within the city.
C. Burning Or Burying Garbage And Refuse:
1. No person shall bury or burn any garbage or refuse in the city except in accordance with regulations established by the state pollution control agency. (Ord. 18, 5-16-1972; amd. 2005 Code)
2. All burning within the city limits requires a permit. The permit can be obtained from the Sabin-Elmwood fire department. All stipulations on said permit will be adhered to, or the homeowner will be assessed for a fire call. (Ord., 8-2002)
D. Placement Of Containers: Garbage and refuse containers shall be placed on the day of collection at ground level on the property and adjacent to the alley or street. They must be removed no later than eight o'clock (8:00) P.M. on the day of collection. (Ord. 18, 5-16-1972)
E. Contagious Disease Refuse: The removal of wearing apparel, bedding or other refuse from homes or places where highly infectious or contagious diseases have prevailed shall be performed under the supervision and direction of the county health officer. Such refuse shall not be placed in containers for regular collections. (Ord. 18, 5-16-1972; amd. 2005 Code)
F. Inflammable Or Explosive Refuse: Highly inflammable or explosive materials shall not be placed in containers for regular collection but shall be disposed of as directed by the fire chief at the expense of the owner or possessor thereof. (Ord. 18, 5-16-1972)
