8-1-1: DEFINITIONS:
For the purpose of this title, the terms defined in this section have the meanings given them:
BLOCK: That property abutting on one side of a street and lying between the two (2) nearest intersecting or intercepting streets, and railroad right of way of unsubdivided acreage.
COURT: An open, unoccupied space on the same lot with a building or buildings and which is bounded on two (2) or more sides by such building or buildings, including the open space in a house court or court apartment providing access to the units thereof.
HOME OCCUPATION: Any occupation or profession engaged in by the occupant of a residential dwelling unit which is clearly incidental and secondary to the residential use of the premises and does not change the character of said premises.
LOT: Land occupied or to be occupied by a building and its accessory buildings, or by a dwelling group and its accessory buildings, together with such open spaces as are required under the provisions of this title, having not less than the minimum area required by this title for a building site in the district in which such is situated, and having its principal frontage on a street.
LOT, CORNER: A lot situated at the intersection of two (2) or more streets, or bounded on two (2) or more adjacent sides by street lines.
LOT, INTERIOR: A lot other than a corner lot.
LOT, KEY: The first lot to the rear of a corner lot, the front line of which is a continuation of the side line of the corner lot, exclusive of the width of any alley, and fronting on the street which intersects or intercepts the street on which the corner lot fronts.
USE: The purpose for which land or premises or a building thereon is designed, arranged or intended or for which it is or may be occupied or maintained.
YARD: An open space, other than a court, on the same lot with a building, which open space is unoccupied and unobstructed from the ground upward, except as otherwise provided in subsection 8-1-2A of this chapter. In measuring a "yard", as hereinafter provided, the "line of a building" means a line parallel to the nearest lot line drawn through the point of a building or the point of a dwelling group nearest to such lot line, exclusive of the respective architectural features enumerated in subsection 8-1-2A of this chapter as not to be considered in measuring yard dimensions or as being permitted to extend into any front, side or rear yard, respectively; and the measurement shall be taken from the line of the building to the nearest lot line; except, that if any future width line has been established from the street on which the lot faces, the measurement shall be taken from such future width line.
YARD, FRONT: A yard extending across the front of the lot between the inner side yard lines and lying between the front line of the lot and the nearest line of the building.
YARD, REAR: A yard extending across the full width of the lot and lying between the rear line of the lot and the nearest line of the building.
YARD, SIDE: A yard between the side line of the lot and the nearest line of the building and extending from the front line of the lot to the rear yard. (Ord. 16, 10-23-1970; amd. 2005 Code)
8-1-2: INTERPRETATION AND EXCEPTIONS:
   A.   The regulations specified in this title shall be subject to the following interpretations and exceptions regarding use:
      1.   Nothing in this title shall be deemed to prohibit the construction or maintenance of any stand or shelter for the sale of agricultural products produced on the premises.
      2.   No filling station, public garage, or gasoline distributing station shall be located within three hundred feet (300') of a school, church, hospital, or public meeting place having a seating capacity of more than fifty (50) persons.
   B.   Nothing contained in this title repeals or amends any ordinance requiring a permit or license to engage in any business or occupation. (Ord. 16, 10-23-1970)
8-1-3: COMPLIANCE WITH PROVISIONS:
   A.   Except as provided in chapter 6 of this title, in each district, land and structures shall be used only for purposes listed in this title as permitted in the district.
   B.   In each district, every building hereafter erected or structurally altered shall be provided with the yards specified, shall be on a lot of the area and width specified, and shall not exceed the height specified in this title for the district. (Ord. 16, 10-23-1970)
