§ 36.01 ESTABLISHMENT.
   There is hereby created the Fire Department, which shall be an executive department of the city. The Fire Department shall be assigned to the Department of Public Health and Safety and shall consist of the Fire Chief and such other members as may be determined from time to time by the City Council.

§ 36.02 DUTIES.
   It shall be the function and duty of the Fire Department, and the duty of the members thereof, to prevent and extinguish accidental or destructive fires occurring in the city, and to enforce all ordinances relating to fire hazards.

§ 36.03 SERVICE OUTSIDE CORPORATE LIMITS.
   Members of the Fire Department are authorized to go outside the corporate limits of the city for the purpose of rendering aid to other fire departments, or of extinguishing fires or rendering aid in the case of accidents. That the Fire Department shall not render this type of service outside the corporate limits excepting upon orders of the Chief of the Fire Department (Fire Chief), the Captain, or the Mayor; excepting that where the city has undertaken by contract to render service to property outside the corporate limits in the fulfillment of such contract.

FIRE CHIEF; FIREFIGHTERS
§ 36.15 FIRE CHIEF; APPOINTMENT.
   There is hereby created the office of Fire Chief, an executive office of the city. The Fire Chief shall be appointed and dismissed by the City Council by a minimum vote of a 4/5 majority.

§ 36.16 SUPERVISION OF DEPARTMENT AND EQUIPMENT.
   It is the Fire Chief who shall have control, subject to the order and direction of City Council, of the Fire Department and all fire apparatus belonging to the city. Whenever any fire apparatus needs repairing, the Fire Chief shall cause the same to be done without delay.

§ 36.17 COMMAND AT FIRES.
   In case of fire, the Fire Chief and his or her assistants shall rank in the order named, and the officer of the highest rank at the fire shall take command of the Fire Department, and direct the management thereof for the suppression of the fire, in the best manner possible; and when it may be necessary for the protection of other property and to prevent the spread of the conflagration, the officer in command may cause buildings to be removed, torn down, or destroyed in the best manner possible.

§ 36.18 RECORDS.
   The Fire Chief shall keep or cause to be kept a record of all meetings of the company and the attendance of the members, a record of all fires, and, during the last week in April of each year, file with the City Clerk a full report of these records of attendance and fires, which report shall be under oath.

§ 36.19 FIRE INVESTIGATION; REPORT.
   It shall be the duty of the Fire Chief to investigate into the cause of any accidental or destructive fire occurring in the city. In case there is reason to suspect that there was any criminal act or violation of a city ordinance in connection therewith, he or she shall report the same to the City Attorney.
