POLICE DEPARTMENT
There is hereby created a Police Department, an executive department of the city. The Police Department shall consist of the Chief of Police and of such number of captains, lieutenants, sergeants, and patrol officers as may be provided from time to time by the City Council.

The Chief of Police shall be appointed and or dismissed by the City Council by a minimum vote of a 4/5 majority. All other appointments to, or promotions within the Department, shall be made by the Fire and Police Commissioners as provided by law.

The Chief of Police shall be the keeper of the city jail, if one exists, and shall have custody of all persons incarcerated therein. He or she shall keep such records and make such reports concerning the activities of the Department as may be required by statute or by the Mayor. The Chief shall be responsible for the performance of the Police Department and of all its functions; and all persons who are members of the Department shall serve subject to the orders of the Chief of Police.

The Chief of Police shall serve for such a term as may be provided by law, and may be removed in the manner provided for the removal of officers. Provided, that if any member of the Police Department, having a rank therein, shall be appointed Chief, upon the expiration of his or her term or the termination of his or her services for any reason, he or she shall resume the status and rank held before his or her appointment as Chief.
