§ 35.02 APPOINTMENTS.

   The Chief of Police shall be appointed and or dismissed by the City Council by a minimum vote of a 4/5 majority. All other appointments to, or promotions within the Department, shall be made by the Fire and Police Commissioners as provided by law.

§ 35.03 RANK.

   The Chief of Police shall be the head of the Department and have supervision over all officers and members thereof. Following him or her in rank shall be the sergeants and police officers, in order of seniority in each group.

§ 35.04 DUTIES OF CHIEF.

   The Chief of Police shall be the keeper of the city jail, if one exists, and shall have custody of all persons incarcerated therein. He or she shall keep such records and make such reports concerning the activities of the Department as may be required by statute or by the Mayor. The Chief shall be responsible for the performance of the Police Department and of all its functions; and all persons who are members of the Department shall serve subject to the orders of the Chief of Police.

§ 35.05 CUSTODY OF STOLEN PROPERTY.

   The Chief of Police shall have the custody of all lost, abandoned, or stolen property recovered in the city.

§ 35.06 TENURE OF CHIEF.

   The Chief of Police shall serve for such a term as may be provided by law, and may be removed in the manner provided for the removal of officers. Provided, that if any member of the Police Department, having a rank therein, shall be appointed Chief, upon the expiration of his or her term or the termination of his or her services for any reason, he or she shall resume the status and rank held before his or her appointment as Chief.

§ 35.07 EQUAL OPPORTUNITY POLICY.

   In making appointments to the Police Department, no person shall be deprived of an opportunity to serve on the Police Department because of race, religion, skin color, national origin, or sex. No arbitrary rules on height, weight, or achievement of strength or unrelated job needs shall be imposed. No handicapped person shall be denied, merely by virtue of being handicapped, appointment to a position on the Police Department which the handicapped person is competent to fill.

§ 35.08 DUTIES OF DEPARTMENT MEMBERS.

   It shall be the duty of the members of the Police Department to see to the enforcement of all of the ordinances of the city and all statutes applicable therein, and to preserve order and prevent infractions of the law, and arrest violators thereof.
