9-1B-14: INSPECTIONS:
   A.   Right Of Entry: The duly authorized and properly identified employees of the department shall have the right, but shall not be obligated to inspect the water supply, piping and plumbing at any customer's premises before or after water service is turned on.
   B.   Refusal Or Discontinuance Of Service: Service may be refused or discontinued when such piping or plumbing is not in conformance with the applicable City ordinance.
   C.   Nonliability Of City: Such inspection or failure to inspect or failure to refuse or discontinue service shall not render the City liable or responsible for any loss, damage or injury resulting from any defects in the piping or plumbing. (1973 Code § 13.12.150)
9-1B-15: RIGHT OF ACCESS:
The duly authorized and properly identified employees of the department shall have access to the customer's premises at all reasonable times for the purposes of inspecting water supply, piping and plumbing; inspection, testing or repairing Water Department equipment and for reading water meters. 9-1C-1: NONLIABILITY OF CITY FOR SERVICE INTERRUPTIONS OR VARIANCES:
   A.   Service Interruptions: The department will use all reasonable means to provide an adequate and continuous water service for all customers; but in case the water service is interrupted or reduced for any cause, the city shall not be liable for any injuries or damages resulting therefrom; and such interruption or reduction in service shall not give rise to any cause of action as for a breach of agreement for service.
   B.   Volume Of Water: The city makes no commitment as to the volume of water available, pressure per square inch or continuity of service and will not be liable for injuries or damages due to insufficient volume, inadequate pressure or interruption of service. (1973 Code § 13.16.010)
9-1C-2: WASTE OR EXCLUSIVE USE OF WATER PROHIBITED:
It shall be the duty of each customer to eliminate waste of the water supply by repairing or causing to be repaired any defective or leaking pipes or plumbing fixtures. No person shall use more water for irrigation, culinary purposes or other uses than is reasonably necessary. (1973 Code § 13.16.020)
9-1C-3: EMERGENCY CONDITIONS:
   A.   Declaration Of Water Service Emergency: When there is a shortage of water in the city's water utility the mayor may make a declaration of water service emergency setting forth reasonable rules and regulations for the use of water for irrigation, lawn and garden watering, car washing and other nonessential uses of water during the duration of the emergency. This declaration may be imposed against water utility customers who receive service both inside and outside the city limits.
   B.   Notice Of Declaration Of Water Service Emergency And Extent Of Restrictions: The mayor's declaration of water service emergency shall be published in the official city newspaper and mailed or delivered to each water customer. There shall be a minimum of five (5) days between the declaration of water service emergency and its effective date.
   C.   Violations Of Water Service Emergency Declaration Restrictions And Regulations: Water service customers both inside and outside the city limits shall be subject to the following penalties for violation of the water service declaration restrictions and regulations:
      1.   First offense: Warning in writing to address of record of customer.
      2.   Second offense: Civil fine of not less than one hundred dollars ($100.00).
      3.   Third offense: Termination of water service for the duration of the water service emergency.
Any person who wishes to protest the imposition of sanctions imposed by this chapter may request a hearing before the city administrator as to the basis for said sanctions and may appeal the city administrator's decision thereof to the city hearing examiner. During the course of any hearing the sanction imposed shall be suspended unless there is a further violation of the water service emergency declaration. (Ord. 753, 7-26-2001)
9-1C-4: DISCONTINUANCE OF SERVICE BY DEPARTMENT:
   A.   Reasons For Discontinuance: The department may refuse to supply or may discontinue service to any customer for violations of this chapter or for failure to pay bills or upon request by the property owner to discontinue service. The department may refuse or discontinue service to any customer who requires or uses such volume of water that the water service to any other customer may be thereby impaired. The department shall discontinue service to any customer who makes an unauthorized connection to a city water line or bypasses a city water meter.
   B.   Discontinuance Not To Release Customer From Charges Due: Discontinuance of service for any cause stated in subsection A of this section shall not release the customer from his obligation to pay the city for bills or charges already incurred.
   C.   Charge For Discontinuance; Restoration: Whenever water service has been discontinued as provided in subsection A of this section, the customer shall be charged a fee as determined by resolution or ordinance of the city council for the discontinuance. Restoration of service at the customer's request, and after payment of all bills due, shall be done at the convenience of the department. (Ord. 904, 3-9-2011)
