(a) General. Failure to comply with any of the requirements of this Part or the applicable provisions of the Code or any other law that applies to the construction, reconstruction, relocation and operation of a newsstand may result in the exercise by the Commissioner of powers granted to him or her in Chapter 1 of Title 20 of the Code, including the power to impose fines and penalties and to suspend, revoke or cancel any license issued by him or her in accordance with the applicable procedures and provisions of such Chapter.
(b) Obligation to cooperate with replacement of newsstands by franchisee. During the removal, reconstruction, relocation, and continuing operation of the licensee's newsstand, the licensee shall not:
(1) Impede or interfere with the removal, reconstruction and/or relocation of the newsstand;
(2) Create a hazardous condition; or
(3) Impede physical access to the newsstand by the franchisee after completion of construction for the purpose of making reasonable repairs to such stand, or for ongoing maintenance by the franchisee, or for an inspection to determine compliance with applicable law.
(c) Waiver of options.
(1) Failure to remove a newsstand at least 5 calendar days prior to the first day of the period during which the franchisee is otherwise scheduled to remove and reconstruct the licensee's newsstand, as provided in notice given pursuant to paragraph (4) of subdivision (e) of 6 RCNY § 2-68, shall be considered a waiver of a licensee's written election to arrange for non-franchisee removal.
(2) Failure of a licensee to communicate an available choice of interior accessories of a replacement newsstand in a timely manner may result in waiver of the right to choose such interior accessories.
(3) Failure to cooperate in any aspect of the transitional procedures contained in subdivision (e) of 6 RCNY § 2-68, or in any other procedure contained in this Part, may result in the forfeiture of options otherwise available to the licensee.
