The United States Circuit Court of Appeals for the Sixth Circuit has held in a recent case that the Federal Railway Safety Act preempts local ordinances regarding railroad obstructions and railroad safety. See CSX Transportation, Inc. v. City of Plymouth, 86 F.3d 626 (6th Cir. 1996). Therefore, the provisions in this chapter have been repealed. For current enforcement, please consult appropriate State law.

(a) No railroad company or person owning, operating or controlling the same shall enter upon or occupy, for the use of its track or switches or for any other purpose, any street or public ground of any kind, or any part thereof, within the corporate limits without first having obtained the written consent of Council, which written consent shall be recorded at length in the journal of the City, or without such street or public ground having first been condemned for such purpose in accordance with the statutes in such cases made and provided.

(b) Whoever violates this section is guilty of a minor misdemeanor. A separate offense shall be deemed committed each day during or on which a violation occurs or continues. The penalty shall be as provided in Section 698.02.
