8-10-3: WATER SERVICE EMERGENCY DECLARED BY THE MAYOR:
Whenever, upon determination by the mayor of the city of Mt. Pulaski, in consultation with such officials as he deems appropriate, the mayor of the city determines that a water service emergency exists in the city of Mt. Pulaski, and that such emergency requires that certain uses of water not essential to the health, welfare and safety of the citizens of the city be restricted and the mayor issues and publishes and posts a declaration of such findings, in a local newspaper of general publication, the provisions of this chapter shall become immediately effective and applicable to all persons or entities served by the Mt. Pulaski water system.
Further, prior to enacting a stage of water restriction, the mayor shall cause to be posted at city hall, the post office, the city website, by mass e-mail to those individuals or entities signed up through city hall on the city's e-mail list, and at any other place deemed appropriate, notice of the stage of water restriction in effect along with the date and time of posting. The stage of water restriction shall take effect twenty four (24) hours after posting of the notice. Once the mayor has declared a water service emergency, it is the responsibility of the city water customers to inform themselves of the current stage of water restriction. Failure of the city to post notice as described due to circumstances beyond their control is not a defense for water customers failing to abide by the restrictions. The notice may be posted at other locations and through other means deemed appropriate.
It is not necessary that the stages of water restriction progress one step at a time. The mayor may declare any stage to be in effect at any time that is deemed appropriate and necessary. (Ord., 7-24-2012)
