It shall be unlawful to construct or maintain any opening or stairway in any public street, alley, sidewalk or other public place without a permit from the mayor and city council.
All such lawfully maintained openings shall be guarded by a suitable strong cover or railing, subject to the approval of the superintendent of streets and alleys. (1967 Code § 12.116)
