GENERAL PROVISIONS
§ 75.01 DEFINITIONS.
   For the purpose of §§ 75.01 through 75.11, the following phrases shall have the following meanings ascribed to them respectively:
   BICYCLE LANE. That portion of a roadway set aside for the use of bicycles and so designated.
   BICYCLE PATH. A pathway constructed for bicycles and so designated.

§ 75.02 APPLICABILITY OF SECTIONS 75.01 THROUGH 75.11.
   The regulations contained in §§ 75.01 through 75.11, shall apply to the operation of bicycles upon any street, sidewalk, bicycle path or bicycle lane unless by the context of any section, a less restrictive application is imposed or implied.

§ 75.03 BICYCLES; APPLICATION OF TITLE VII.
   (A)   The provisions of this title that are applicable to bicycles or electric bicycles apply whenever a bicycle or electric bicycle is operated upon any highway or upon any path set aside for the exclusive use of bicycles.
   (B)   Except as provided in division (D) of this section, a bicycle operator or electric bicycle operator who violates any provisions of this title described in division (A) of this section that is applicable to bicycles or electric bicycles may be issued a ticket, citation, or summons by a law enforcement officer for the violation in the same manner as the operator of a motor vehicle would be cited for the same violation. A person who commits any such violation while operating a bicycle or electric bicycle shall not have any points assessed against the person’s driver’s license, commercial driver’s license, temporary instruction permit, or probationary license under R.C. § 4510.036.
   (C)   Except as provided in division (D) of this section, in the case of a violation of any provision of this title described in division (A) of this section by a bicycle operator, electric bicycle operator, or motor vehicle operator when the trier of fact finds that the violation by the motor vehicle operator endangered the lives of bicycle riders or electric bicycle riders at the time of the violation, the court, notwithstanding any provision of the Ohio Revised Code to the contrary, may require the bicycle operator, electric bicycle operator, or motor vehicle operator to take and successfully complete a bicycling skills course approved by the court in addition to or in lieu of any penalty otherwise prescribed by this Traffic Code or the Ohio Revised Code for that violation.
   (D)   Divisions (B) and (C) of this section do not apply to violations of R.C. § 4511.19, or a substantially equivalent municipal ordinance.

§ 75.04 TRAFFIC-CONTROL DEVICES.
   (A)   The City Manager may provide for and install upon any street, sidewalk, bicycle path or bicycle lane such signs or traffic-control devices as he or she deems necessary to implement the provisions of §§ 75.01 through 75.12, governing the operation of bicycles or reasonably necessary to assure the public safety or the flow of traffic.
   (B)   No person shall disobey the instructions of any traffic-control device placed in accordance with the provisions of this section unless at the time otherwise directed by a police officer.

§ 75.05 RIDING ON SIDEWALKS, PLAYGROUNDS, ETC.
   (A)   A person operating a bicycle on a sidewalk shall yield the right-of-way to any pedestrian and shall give audible signal before overtaking and passing such pedestrian.
   (B)   No person shall operate a bicycle, moped, or other motor vehicle or motor-assisted vehicle upon any park, playground or schoolground where children are playing without the permission of the persons having supervision of the park, playground or schoolground.

§ 75.06 BICYCLE PATHS AND LANES.
   (A)   A bicycle operator approaching a bike path or lane shall yield the right-of-way to bicycles approaching on such path or lane.
   (B)   The operator of a motor vehicle approaching a bike path or lane from a driveway, or public or private street, shall yield the right-of-way to bicycles on such path or lane.
   (C)   No person shall operate a bicycle upon a roadway adjacent to which or upon which bicycle paths or lanes have been designated except within such lane or upon such path.
   (D)   No person operating a bicycle shall overtake and pass a moving bicycle except at the left of the bicycle being passed. Passing shall not be undertaken where the width of the path is insufficient to accommodate two bicycles abreast or where any danger to the bicycle overtaken is occasioned by such act.
   (E)   No person shall ride an animal or operate a motorized vehicle on a bicycle path except when the motorist or rider is lawfully crossing the path.
   (F)   Bicycle paths shall not be obstructed by garbage cans or other objects or by parked cars or other motor vehicles.
