4-1-5: PROCEDURE FOR NONPAYMENT:
In the case of nonpayment with respect to a bill for services rendered, the Village shall have the following options:
   A.   Issue a citation for non-compliance;
   B.   File a complaint at law seeking any and all monies due the Village including late fees and attorney fees. (Ord. 1837, 4-11-2018)
4-1-6: COLLECTION OF LANDSCAPE WASTE:
After July 1, 1990, it shall be unlawful for any person within the Village limits to place, or in any manner intermingle, "landscape wastes" with garbage and rubbish for disposal by the scavenger service provided by the Village. All landscape waste will be collected and disposed of as follows:
   A.   Collection: All landscape waste shall be collected by the same licensed scavenger service that collects garbage and refuse for the Village under separate agreement between the residents of the Village and the scavenger service.
   B.   Placement In Bags:
      1.   All landscape waste will be collected and must be contained in special biodegradable thirty (30) gallon paper bags to be sold to the public at various locations in the Village, or contained in a one hundred (100) gallon container cart to be sold or rented by the licensed Village scavenger service and a monthly collection fee paid to the scavenger service as provided hereafter.
      2.   No collection of said materials will be made, however, unless they are contained in the special paper bags or special container, and unless the owner, occupant or lessee has entered into a separate agreement with the scavenger service.
   C.   Voluntary Use Of Service: No resident of the Village will be obligated to use the collection services for landscape waste. (Ord. 689, 6-13-1990)
   D.   Service Charges:
      1.   The cost of the paper bags and the costs of rental of the container carts and monthly pick up services will be determined by and paid directly to the licensed Village scavenger service, and the Village shall have no obligation to collect said fees. The initial cost of said items and services shall be as follows:

      2.   The container carts may be used for regular garbage and refuse from December through March. (Ord. 689, 6-13-1990; amd. 1999 Code)
   E.   Time Of Collection: The collection of landscape waste will be on the same day as the collection of other garbage and rubbish in the Village. (Ord. 689, 6-13-1990)
4-1-7: CONTAINERS AND STORAGE OF GARBAGE AND REFUSE:
   A.   Garbage Handling; Container Requirements: All garbage of any person shall be drained, wrapped and stored in durable, rust resisting, nonabsorbent, watertight, and easily washable metal or plastic containers, which shall have close fitting covers and adequate handles to facilitate collections, and shall be not more than thirty five (35) gallons or less than twenty (20) gallons in capacity, with the exception that the one hundred (100) gallon container carts described in subsection
   B.   Rubbish: All rubbish shall be stored in durable, metal or plastic containers with close fitting covers. (Ord. 689, 6-13-1990)
   C.   Placement Of Containers For Collection; Time Period: It shall be the duty of the person having household garbage or rubbish to comply with all provisions of this chapter, and on each day of garbage, rubbish or recycling collection to place the containers as aforesaid on the curb in front of the residential premises receiving said disposal services no earlier than twelve o'clock (12:00) noon on the day before collection and should be removed by seven o'clock (7:00) P.M. the day of collection. All garbage, rubbish, or recycling containers shall not be stored in the front yards on non-trash days. All garbage, rubbish, or recycling containers shall be stored behind a privacy fence or out of view from public areas. (Ord. 1908, 4-10-2019)
4-1-8: DISPOSAL OF GARBAGE, RUBBISH AND LANDSCAPE WASTE:
   A.   Placement Of Garbage In Suitable Container: It shall be unlawful for any person to dispose of or place any garbage, rubbish, or landscape waste in any street, alley or sidewalk or any other public place within the Village, nor shall any person dispose of or place any garbage or rubbish on private property, whether owned by such person or not, within the limits of the Village, unless the same shall be enclosed in a suitable container so that it cannot be blown about by ordinary winds.
   B.   Compost Pile Or Container: Landscape waste may be placed on private property in what is commonly known as a "compost pile" or a container used for composting; provided, however, that such compost pile or container shall not create a public nuisance as a result of smell or otherwise. 4-1-9: INSTITUTIONAL, INDUSTRIAL AND COMMERCIAL UNITS:
   A.   Duty Of Institution: The foregoing provisions of this chapter with regard to collection of garbage, rubbish and landscape waste, shall not apply to any institutional, industrial or commercial unit in the Village. It shall be the duty of such institutional, industrial or commercial unit in the Village at its own cost to arrange with a properly licensed scavenger for the disposal of its "garbage", "rubbish" and "landscape waste" as herein defined, as well as its market and industrial wastes. Such institutional, industrial or commercial unit, including any corporation, partnership or person engaged in running a store, business or commercial or industrial enterprises of any kind shall keep its premises free and clear of any accumulation of "garbage", "rubbish", or "landscape waste" as above defined or of market or industrial waste of any kind.
   B.   Time Of Collection: Such institutional, commercial, and industrial garbage, rubbish and landscape waste, including market and industrial waste, shall be collected each week or as often as is necessary to prevent any accumulation of same which would cause any nuisance or health hazard or the breeding of insects. In no event shall such collection be made less frequently than once in each week.
   C.   Storage In Closed Containers: Institutional, commercial, and industrial garbage, rubbish, and landscape waste and other waste shall be stored in closed containers so as not to cause litter or a nuisance or health hazard. (Ord. 689, 6-13-1990)
   D.   Screening: All trash container areas shall be fully screened from streets and adjacent properties with a maintenance free six foot (6') high privacy type fence, brick wall or landscaped area placed around said facility. All trash containers or receptacles must be placed on a concrete pad sufficient to support said container, in accordance with Village of Monee Construction Codes. (Ord. 1923, 6-26-2019)
4-1-10: BURNING OF REFUSE:
   A.   Burning Garbage Prohibited: No person shall set fire to or burn out of doors upon any premises located within the Village any material defined as "garbage" by section 4-1-1 of this chapter.
   B.   Creating Nuisance: No person shall set fire to or burn out of doors upon any premises located within the Village any material that upon combustion creates smoke and/or odor which constitutes a nuisance to surrounding premises; and that if the burning of any combustible material constitutes a nuisance to surrounding premises, such fire shall be extinguished by the person by whom it was set.
   C.   Fire Limits: No person shall set fire to or burn rubbish or other combustible material out of doors upon any premises located within the fire limits of the Village, except upon specific permission of the Village President and the Fire Chief of the Monee Fire Protection District.
   D.   Setting Fire On Public Ways: No person shall set or maintain any rubbish fire on any public right-of-way, including curb and gutter, sidewalk, alley or parkway. (Ord. 689, 6-13-1990)
