4-2-1: NOXIOUS WEEDS DEFINED; DECLARATION OF NUISANCE:

No person shall permit the growth upon any premises of any noxious weeds, except as hereinafter provided. Canada thistles and all of its varieties, perennial sow thistles, European bindweed, leafy spurge, Russian knapweed, Johnson grass, giant foxtail, hoary cress, jimson, burdock, cockleburs, ragweed and similar weeds and all weeds which, due to pollination, are a menace to health, are, for purposes of this chapter, defined as noxious weeds. No person owning, leasing, occupying or controlling any plot of real estate shall permit the growth of noxious weeds thereon except as hereinafter provided. (Ord. 1155, 8-22-2001)

4-2-2: RESPONSIBILITY FOR REMOVAL:

   A.   All grass used for landscaping purposes or grown wild on vacant property shall not exceed six inches (6") in height at any time.

   B.   All weeds shall be pulled or otherwise destroyed by the owner, lessee, tenant, occupant or person in control of real estate in the Village whenever weeds growing on such property exceed six inches (6") in height, but in no event less often than twice a year, once between June 15 and July 1, and once between August 1 and August 15. Failure to destroy such weeds of the height specified or within the designated periods shall constitute a violation of this chapter.

   C.   If the tract of real estate on which such weeds or grasses are located exceeds one (1) acre in area, is unsubdivided and is vacant, the owner, lessee, tenant, occupant or person in control of such real estate shall be required to cut grass, pull or otherwise destroy those weeds located within thirty feet (30') of the perimeter of such real estate.    D.   In addition to the responsibilities imposed upon any person owning, leasing, occupying or controlling any plot of real estate, the said responsibility shall also apply to any real estate that is adjoining and abutting the property line of the said real estate to the improved area of the said dedicated right-of-way.
