Within forty-five (45) days after submission of all plans and documents required of the applicant and payment of the permit fees required by this legislation, the Village Administrator, if satisfied that the applications, plans and documents comply with all requirements of this legislation, shall issue a construction permit, subject to such further conditions, restrictions or regulations affecting the time, place and manner of performing the work as the Village Administrator may deem necessary or appropriate to preserve public safety and welfare and to minimize damage, disruption and inconvenience to the public.

The permit holder shall submit a written construction schedule consistent with the construction permit and other conditions imposed by the Village Administrator to the Village Administrator ten (10) working days before commencing any work within or along the public ways. The permit holder shall further notify the Village Administrator and the Ohio Utility Protection Service (OUPS) not less than (2) working days or forty-eight (48) hours in advance of any work in the public ways.

All construction practices and activities shall be in accordance with the construction permit and approved final plans and specifications for the facilities. The Village Administrator shall be provided access to the work and such further information as he or she may require to ensure compliance with such requirements. Field changes may be approved by the Village Administrator if such changes are determined to be necessary due to site conditions or other changed circumstances.
Upon order of the Village Administrator, all work that does not comply with the construction permit, the approved plans and specifications for the work, or the requirements of this legislation, shall immediately cease and be corrected by the permit holder or be subject to removal pursuant to Section 977.06.
