   979.01 GENERAL.
   No person shall commence or continue with the construction, installation, maintenance or repair of facilities or excavation within the Village except as provided in this chapter.

   979.02 CONSTRUCTION CODES.
   Facilities shall be constructed, installed, operated, and maintained in accordance with all applicable federal, State and local codes, rules and regulations including, but not limited to, the National Electrical Safety Code.

   979.03 CONSTRUCTION PERMITS.
   No person shall construct, install, maintain or repair any facilities within the public ways, or excavate within the public ways, without first obtaining a construction permit therefor, provided that, any person who began any such work within the public ways prior to the effective date of this legislation shall have sixty (60) days to complete and submit an application for a construction permit for such work and provided further that if the proposed work involves no excavation and causes no disruption to the use of the public way and areas adjacent thereto, the Village may provide express written permission to except such work from the requirements of this chapter. No construction permit shall be issued unless the applicant has filed a registration statement with the Village pursuant to Chapter 973 and received a use permit pursuant to Chapter 975.

   979.04 EMERGENCY RESPONSE WORK.
   In the event of an immediate need for emergency response work that would require a construction permit under Chapter 979, a use permit holder may commence such emergency response work as required under the circumstances, provided the use permit holder shall notify the Village as promptly as possible, before such emergency response work or within twenty-four (24) hours after commencing such emergency response work if advance notice is not practicable. The permit holder shall apply for a construction permit within five (5) days of commencing such emergency response work.

   979.05 APPLICATIONS.
   Applications for construction permits shall be submitted upon forms to be provided by the Village in a format to be determined by the Village and shall be accompanied by drawings, plans and specifications in sufficient detail to demonstrate, as applicable:
     (a)    That the facilities will be constructed or maintained, or the public way excavated, in accordance with all applicable codes, rules and regulations.
    (b)    The location and route of all facilities to be installed on existing utility poles.
    (c)    The location and route of all facilities to be located under the surface of the ground, including the line and grade proposed for the burial at all points along the public ways. Some method of locating and identifying the facility during future construction activities shall be installed with the facilities, such as magnetic and fluorescent tape placed at a minimum of one foot to a maximum of two feet above the entire facility.
   (d)    The location of all existing underground facilities within the public ways within which the applicant proposes to install facilities.
   (e)    The location of all other facilities to be constructed within the Village, but not within the public ways.
   (f)    The construction methods to be employed for protection of existing structures, fixtures and facilities within or adjacent to the public ways.
   (g)    The location, dimension and types of all trees within or adjacent to the public ways along the route proposed by the applicant, together with a landscape plan for protection, trimming, removing, replacing and restoring any trees or areas to be disturbed during construction.

   979.06 ENGINEER'S CERTIFICATION.
   Upon the request of the Village Administrator, all construction permit applications shall be accompanied by the certification of a State registered professional engineer that the drawings, plans and specifications submitted with the application comply with applicable technical codes, rules and regulations.

   979.07 TRAFFIC CONTROL PLAN.
   All construction permit applications that involve work on, in, under, across or along any public ways shall be accompanied by a traffic control plan demonstrating the protective measures and devices that will be employed, consistent with the Ohio Department of Transportation's Uniform Manual of Traffic Control Devices and other guidelines, to prevent injury or damage to persons or property and to minimize disruptions to pedestrian and vehicular traffic.
