1155.01 SCHEDULE OF DISTRICT REGULATIONS.
   District regulations for individual districts shall be as set forth in the Schedule of District Regulations, which shall be a part of this Zoning Code, and in Chapter 1165 et seq. entitled Supplemental Regulations.
   Densities as shown on the schedule should be calculated based on the gross acreage of the property. Minimum floor area requirements refer to main structures and for the purpose of this section "Minimum Floor Area" shall mean the sum of the floor area of dwelling units which have a minimum ceiling height prescribed by the Building Code, exclusive of porches, breezeways, basement rooms and garages. Minimum setbacks refer to all structures.
   Chapter 1158, Planned Development Overlay District Regulations, are hereby incorporated with the Schedule of District Regulations to the extent they are made explicitly applicable to any of the districts established in this Section 1155.01 , however, nothing contained herein shall be interpreted as creating a right to such overlay, the availability of an overlay is and shall be exclusively governed by the applicable sections and provisions of Chapter 1158.

SPECIAL DISTRICTS
Special districts may be established where it is determined by Council that special treatment is in the public interest. Such districts shall overlay the regular zoning classification and the regulations and standards associated with such special districts shall apply in addition to the requirements of the regular zoning classification.
Flood Hazard - FH
Purpose and Intent
Determination of Flood Hazard Areas
Permitted Uses
It is intended to establish certain flood hazard districts along the waterways and drainage courses within the City which are subject to severe periodic inundation, and within such areas to regulate and restrict land use in such a manner as to protect life and property and to prevent or minimize damage.
Flood hazard areas shall be established in accordance with the following schedule of determination: floodways and flood plains of all waterways shall be considered to extend from the normal banks of said waterways to the limit of a water elevation line for a 100-year frequency flood. Said water elevations limit line, when not determined by the City shall be determined by the applicant for zoning reclassification, site development plan approval or subdivision approval. Calculations for design floods shall be related to existing land use and potential development under existing zoning. The cost for determination of water elevation limits shall be entirely borne by said applicant, and the results of such determination shall be verified by the City. Wherever floodways and/or flood plains have been determined, said areas shall be considered as a flood hazard district during any procedure for zoning amendment, subdivision, or site development plan.
Permitted uses and structures shall be as permitted by the district in which the parcel or parcels are located provided, however, that:
(a) No use, structure, or activity, including the filling of land shall be permitted in any floodway which adversely affects the normal flood flow, increases flooding of lands above and below the property, increases erosion within or adjoining the floodway, causes diversion of flood waters in a manner more likely to create damage, or increase peak flows or velocities in a manner likely to lead to added property damage;
In order to minimize hazard, it is intended to distinguish between floodways, defined as channels through which water passes at substantial depths or velocities and bordering areas needed for structural controls and flood plains where inundation may occur but where depth and velocities are generally low during floods. It is further intended that regulations shall relate to design floods, defined as floods likely to occur under probable conditions at 100-year frequencies.
(b) Use and structures permitted in flood plains shall be limited to those least likely to be damaged by the kind and amount of flooding anticipated. Any structures permitted in flood plains shall be so located, elevated and constructed to minimize potential hazards and damage from probable flooding, resist flotation, and offer minimum obstruction to flood flow.

OLD VILLAGE - OV
Purpose and Intent
The purpose of the Old Village District (OV), hereinafter sometimes referred to as the Old Village, is to:
(1) preserve, stabilize, restore and enhance pedestrian-oriented small- scale commercial and residential neighborhoods and to provide through mixed-use development only for those commercial activities which are compatible with a neighborhood of this character;
(2) protect the unique historic and architectural character of the Old Village and to ensure historic preservation in the district;
 
(3) strengthen the economy of the City through the preservation and creation of jobs;
(4) increase the City’s tax base by encouraging reinvestment in historic buildings and redevelopment within the Old Village;
(5) further implement the City’s Comprehensive Plan.
The goal of preservation and redevelopment within the Old Village is to create a vibrant residential, office, and retail district in the heart of the City benefitting property owners, residents, and visitors in particular and all citizens in general, economically, socially and culturally.
 
Residential:
 
(1) Single, duplex, and multi-family residential dwellings of at least 1,200 square feet per dwelling unit. Accessory uses customarily incidental to residential use.
(2) Live/work units only upon issuance of a conditional use permit.
(3) Independent and semi-independent residential facilities only upon issuance of a conditional use permit.
(4) Home occupations only upon issuance of a conditional use permit.
Medical:
(5) Offices of licensed medical professionals.
(6) Hospitals, medical clinics and treatment centers, rehabilitation centers and facilities, nursing, assisted living, group care, and other similar skilled care facilities and/or homes all only upon issuance of a conditional use permit.
Education and Recreational:
(7) Public schools, private schools, and any substantially similar educational facilities all only upon issuance of a conditional use permit.
 
(8) Sports, recreation, fitness, training and any similar physical activity facilities and/or establishments all only upon issuance of a conditional use permit.
 
(9) Theater, concert, assembly and meeting halls, houses of worship, and any such similar group meeting venues all only upon issuance of a conditional use permit.
 
(10) Library, museum and public facilities all only upon issuance of Office, conditional use permit.
 
Retail and Services:
 
(11) Child and adult day care centers only upon issuance of a conditional use permit.
 
(12) Offices of professional service providers in the fields of banking, finance and financial services, accounting, taxation, insurance, real estate, architecture, engineering, information technologies, and law. Offices of other substantially similar professional service providers only upon issuance of a conditional use permit. Drive-through and ATM facilities associated with one of these uses may be permitted only upon issuance of a conditional use permit.
(13) Traditional retail establishments not in excess of 15,000 square feet of gross leaseable space except only upon issuance of a conditional use permit. Drive-through facilities associated with one of these uses may be permitted only upon issuance of a conditional use permit.

The following uses are prohibited within the OV district:
(1) Sexually-oriented businesses.
(2) Tattoo and/or body piercing establishments.
 
(3) Massage parlors. The offices of duly licensed massotherapists are not included in this prohibition.
 
(4) Drive-through facilities unless express provision is made for the issuance of a conditional use permit for the specified use.
 
Prohibited uses are enumerated herein solely to avoid potential confusion in interpretation with those uses which are permitted and conditionally permitted within the OV district. This enumeration of prohibited uses is not to be interpreted as either expressly or impliedly permitting any uses other than those which are expressly permitted or conditionally permitted by the district regulations.
