§ 3A-20. TRANSPORTATION OR ROAD CONCURRENCY.
   (a)   Capacity for transportation facilities shall be evaluated by using the Florida Highway System Plan Level of Service Standards and Guidelines Manual, prepared by the Florida Department of Transportation, January 1, 1989 or its most current version.
   (b)   The transportation facility shall have the capacity to serve a proposed development at the adopted level of service standards found in the Traffic Circulation Element of the Comprehensive Plan.
   (c)   Projected impacts on the transportation facility shall be determined by utilizing the trip generation standards set forth in the Brevard County Impact Fee Equation. Any dispute involving the trip general standards of a proposed development shall be settled by using the Institute of Transportation Engineers, “Trip Generation Manual,” 4th Edition, or its most current version.
   (d)   Concurrency evaluation shall be measured at the ingress and egress points to the accessing transportation link or segment.
   (e)   In determining the capacity of the transportation facility, it shall be assumed that all projects funded for construction in the Capital Improvements Program of the Town, as well as those funded and evidenced by contract by county, state or federal agencies in their annual budgets, have been completed and are a part of the system.
   (f)   If the proposed development accesses a state or county transportation facility, the Town shall require an approval letter from Brevard County or the Florida Department of Transportation that access will be approved upon submittal of appropriate engineering and design exhibits for a driveway permit or shall require the actual permit itself.
   (g)   The current operating level of service shall be based upon the most recent average daily traffic counts available plus back ground traffic.
   (h)   The calculation of total traffic generated by a proposed non-residential project will assume 100% build-out and occupancy of the project. Credit against trip generation rates for certain non-residential uses may be taken by utilizing the percentages shown below. Any capture of trips from passing traffic for uses not listed below must be justified by the applicant's use of accepted engineering principles.
