The collector shall perform a service of high quality and keep the number of legitimate complaints to a minimum. Complaints received before 12:00 noon each day shall be serviced by no later than 5:00 p.m. that day. Complaints received after 12:00 noon each day shall be serviced by no later than 12:00 noon the following day. For each month in which the number of legitimate complaints reaches 20 or more for any cause, the town shall be entitled to claim liquidated damages to $10.00 per complaint, but this provision shall in no way be construed to be a waiver by the customer or the town of any performance of any responsibility by the collector under a franchise agreement. Each claim shall be considered legitimate unless disposition reasonably satisfactory of the claim is furnished to the town within the time frame set forth in this section. A record of each complaint and disposition thereof shall be submitted to the Town Manager monthly.
