§ 47-12. GENERAL PROVISIONS OF ANY FRANCHISE AGREEMENT WITH A COLLECTOR.
   (a)   A collector shall conduct operations under a franchise in compliance with all applicable laws.
   (b)   All dealings and contracts between a collector and the town shall be between the Town Manager, or his or her designee so designated in writing, on behalf of the town and a person designated in the franchise agreement by the collector.
   (c)   A collector operating under a franchise agreement with the town shall not assign, underlet or sublet the franchise or any part thereof without the written consent of the Town Commission, and in the event such consent shall be gained, the collector shall be liable for the faithful performance of the terms under which the franchise is granted for the remainder of the term of the franchise. The Town Commission may disapprove any assignment, subletting or underletting for any reason or no reason.
   (d)   Employees of the collector shall not be required to pickup solid waste, if homeowners or tenants have a vicious animal as so declared by Brevard County which is not properly leashed or otherwise restrained, so as not to interfere with the collector's responsibilities under its franchise agreement.
   (e)   All non-confidential records of the collector which are related directly or indirectly in relation to the performance of a franchise agreement, any duties, obligations, or responsibilities pursuant to the agreement, or voluntarily undertaken pursuant to the agreement or in connection with the agreement shall be deemed to be public records, if so deemed under Florida law and Chapter 119, Florida Statutes, as amended from time to time. Confidential records shall include matters related to the cost of the service provided under the franchise agreement, the profit and loss of the collector, payroll, vendor payments, and all other documents that contain competitive information. During the term of the franchise agreement and for five years after termination of the agreement, the collector shall not dispose of said documents or records. Upon request by the Town, the collector shall supply copies of said public records to the town without cost to the town.
