§ 40-1. DRIVING ON BEACHES.
   It shall be unlawful for any person to drive, operate or control any motor vehicle, motorcycle, scooter, powered sand sled or similar vehicle on any beach or over or on any dune area within the limits of the town. This section shall not apply to any motor vehicle, scooter, powered sand sled, or similar vehicle lawfully used by governmental authorities or their agents in the maintenance of the beach; used solely for emergency rescue of boaters, swimmers, sunbathers, or other persons in distress, or used by law enforcement personnel in the pursuit of their governmental duties. The Town Commission may issue a permit to private individuals for periodic use of motor vehicles, motorcycles, scooters, powered sand sleds or similar vehicles, when such use will promote the public health, safety or welfare of the community and will result in circumstances making it easier for the town to enforce this code or accomplish the purposes of this code.
