§ 30-41. DEFINITIONS.
   (a)   For the purpose of this chapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   COUNTY. The word "County" shall mean Brevard County, Florida.
   COURT CLERK. The term "Court Clerk" shall refer to the Clerk of the Circuit and County Courts of Brevard County.
   CROSSWALK. A crosswalk is:
      (1)   That part of a roadway at an intersection included within the connections of the lateral lines of the sidewalks on opposite sides of the highway, measured from the curbs or, in the absence of curbs, from the edges of a traversable roadway; or
      (2)   Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface.
   DESIGNATED PARKING SPACE. A "designated parking space" shall mean any parking space posted within a sign bearing the internationally accepted wheelchair symbol and the caption "PARKING BY DISABLED PERMIT ONLY" as set forth in § 30-43.
   HANDICAPPED PERSON. The words "handicapped person" shall mean any person with permanent mobility problems who has been issued an exemption entitlement parking permit or license plate pursuant to Sections 316.1958, 320.084, 320.0842, 320.0843, 320.0845, or 320.0848, Florida Statutes.
   INTERSECTION. The word "intersection" shall mean:
      (1)   The area embraced within the prolongation or connection of the lateral curblines; or, if none, then the lateral boundary lines of the roadways of two highways which join one another at, or approximately at, right angles; or the area within which vehicles traveling upon different highways joining at any other angle may come in conflict; or
      (2)   Where a highway includes two roadways 30 feet or more apart, then every crossing of each roadway of the divided highway by an intersecting highway shall be regarded as a separate intersection. In the event such intersecting highway also includes two roadways 30 feet or more apart, then every crossing of two roadways shall be regarded as a separate intersection.
   MOTOR VEHICLE or VEHICLE. The words "motor vehicle" or "vehicle" shall mean any vehicle which is self-propelled by any means whatsoever.
   OFFICIAL SIGNS. The words "official signs" shall mean any sign which is placed or erected by the authority of a public body having jurisdiction for the purpose of regulating traffic or parking.
   OFFICIAL TRAFFIC CONTROL DEVICES. The words "official traffic control devices" shall mean all signs, signals, markings, and devices, not inconsistent with this article, placed or erected by authority of a public body or official having jurisdiction for the purposes of regulating, warning or guiding traffic.
   OWNER. The word "owner" shall mean a person who holds the legal title of a vehicle, or, in the event a vehicle is the subject of an agreement for the conditional sale or lease thereof, with the right of purchase upon performance of the conditions stated in the agreement and with an immediate right of possession vested in the conditional vendee or lessee, to possession, then such conditional vendee, or lessee, or mortgagor shall be deemed the owner, for the purpose of this article.
   PARK or PAVING. The words "park" or "parking" shall mean the standing of a vehicle, whether occupied or not, other than temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers as may be permitted under this article.
   PEDESTRIAN. The word "pedestrian" shall mean any person on foot.
   PEDESTRIAN WAY/PEDWAY. A transportation facility designed for use by pedestrians which may be used by other forms of non-motorized transportation.
   PERSON. The word "person" shall mean any natural person, firm, co-partnership, association, corporation, or other legal entity.
   PRIVATE ROAD or DRIVEWAY. The words "private road" or "driveway" shall mean any privately owned way or place used for vehicular travel by the owner and those having express or implied permission from the owner, but not by other persons.
   PUBLIC PARKING SPACE. The words "public parking space" shall mean any parking space on private property which the owner, lessee, or person in control of such property provides for use by members of the public other than employees of such owner, lessee, or person, including, but not limited to, parking spaces at shopping centers, stores, offices, motels, and restaurants.
   SAFETY ZONE. The words "safety zone" shall mean the area or space officially set apart within a roadway for the exclusive use of pedestrian and protected or so marked by adequate signs or authorized pavement markings as to be plainly visible at all times while set apart as a safety zone.
   SIDEWALK. The word "sidewalk" shall mean that portion of a street between the curbline, or the lateral line, of a roadway and the adjacent property lines, intended for use by pedestrians.
   STAND or STANDING. The words "stand" or "standing" shall mean the halting of a vehicle, whether occupied or not, other than temporarily, for the purpose of, and while actually engaged in, receiving or discharging passengers, as may be permitted by this article.
   STOP or STOPPING. The words "stop" or "stopping" shall mean when prohibited, any halting, even momentarily, of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or to comply with the directions of a law enforcement officer or traffic control sign or signal.
   STREET or HIGHWAY. The words "street" or "highway" shall mean the entire width between the boundary lines of every way or place of whatever nature when any part thereof is open to the use of the public for purposes of vehicular traffic.
   TRAFFIC. The word "traffic" shall mean pedestrians, ridden or herded animals, and vehicles, and other conveyances either singly or together while using any street or highway for purposes of travel.
   TRAFFIC HEARING OFFICER. The term "traffic hearing officer" shall refer to a civil traffic infraction hearing officer as provided for pursuant to Sections 318.30 et seq., Florida Statutes, and established Sections 106-96 and 106-97 et seq, Brevard County Code.
   (b)   The definitions set forth in Section 316.003, Florida Statutes, are hereby incorporated by reference as if fully set forth herein.
