5-2-1: NONAERIAL COMMON FIREWORKS ALLOWED:
   A.   It shall be unlawful for any person, partnership or firm to have in possession, for sale or distribution within the city limits, any fireworks not designated nonaerial common fireworks in Idaho Code section 39-2602.
   B.   Fireworks other than nonaerial common fireworks shall not be discharged within the city limits by any person or firm at any time. Provisions of subsection 5-2-2A of this chapter shall not be construed to conflict with this subsection. (Ord. 71, 6-16-1977; amd. 2008 Code)
5-2-2: PUBLIC DISCHARGE OR DISPLAY:
   A.   The city council may, in its discretion, grant or permit the display and discharge of fireworks at civic pageants or civic gatherings under the joint supervision of the city council and the county sheriff's department. (Ord. 71, 6-16-1977; amd. 2008 Code)
   B.   Fireworks shall not be discharged on city property or Melba School District property within the city limits by any person or firm, at any time, unless permission is granted by the city council. (Ord. 140, 6-8-1993)
