8-9-1: DEFINITIONS:
For purposes of this chapter, the following terms have the meanings ascribed:
ALCOHOLIC BEVERAGE: As defined in Iowa Code chapter 123.
DISORDERLY PREMISES: Any premises that constitutes a threat to public peace, health, safety or general welfare of the public by constituting the source of:
   A.   Persons engaging in fighting or threatening violent or tumultuous behavior;
   B.   Unreasonable noise as defined as a "noise disturbance" in chapter 6 of this title or noise which is otherwise prohibited in said chapter;
   C.   Hazardous or offensive conditions such as, but not limited to, solid waste violations, public urination, public defecation, and indecent exposure.
EVENT OR GATHERING: Any group of two (2) or more persons who have assembled or gathered together for a social function or other activity on public or private property whether indoors or outdoors.
HOST: To aid, conduct, allow, entertain, control or overtly permit a gathering or event. Mere knowledge that an event or gathering is occurring is insufficient to constitute host status; but presence at the gathering or event combined with right of possession or control of the premises upon which the event or gathering is occurring is presumed to satisfy host status.
NUISANCE GATHERING: An event or gathering that constitutes, or results in the occurrence of two (2) or more illegal activities at or as a result of the event or gathering at the premises, including, but not limited to, the following:
   A.   Noise in violation of chapter 6 of this title;
   B.   Public disturbances, assaults, brawls, fights, indecent exposure, public urination or public defecation;
   C.   Unlawful sale, furnishing, or consumption of an alcoholic beverage or public intoxication;
   D.   Unlawful deposit of solid waste in violation of title 4 of this Code or section 8-3-12 of this title;
   E.   Criminal mischief in violation of chapter 716 of the Code of Iowa;
   F.   Criminal trespass in violation of chapter 716 of the Code of Iowa;
   G.   Unlawful sale, manufacture, or possession of any controlled substance;
   H.   Any violation of Iowa Code section 124.414 regarding the manufacture, delivery, sale or possession of drug paraphernalia;
   I.   Violation of Cerro Gordo County ordinance 51 regarding social host and underage consumption;
   J.   Violation of section 8-3-6 of this title regarding disorderly conduct;
   K.   Criminal sale or use of fireworks in violation of Iowa Code section 727.2 or section 8-3-8 of this title;
   L.   Driving any motorized vehicle or other self- propelled machine resulting in a crash, property damage, personal injury, reckless driving, or otherwise in a careless, dangerous or reckless fashion within one thousand five hundred feet (1,500') of the closest point on the property at issue.
PREMISES: Any house, residence, yard, land, apartment, condominium, hotel or motel room, park, business, or other place of assembly, private or public, whether owned, leased, or used with or without permission or compensation.
UNDERAGE PERSON: Any individual under the age of twenty one (21) years of age. (Ord. 13-16, 5-7-2013)
