8-3-12: LITTER, DEPOSIT OF:
   A.   Litter Prohibited: It shall be unlawful for any person to throw, leave or permit to remain upon any street, alley, stream or public place, or upon any privately owned property any litter, debris or refuse of any kind, including, but not limited to, cigarette butts, garbage, paper, cardboard, cans, bottles, tacks, wires, nails, discarded glassware, floor covering, building material, clothing, ashes, brush; such as straw, weeds and tree trimmings, except that the owner may deposit the same upon his premises when confined in a proper working receptacle with a tight fitting cover except that it shall be lawful for such litter, debris and refuse to be properly transported and discarded at the Cerro Gordo County landfill.
   B.   Fine: Any person convicted of violating this section is guilty of a simple misdemeanor punishable by a minimum fine of one hundred dollars ($100.00).
   C.   Exception: Property owners or tenants who create a nuisance upon property under their control would be subject to the provisions of the nuisance ordinance. (Ord. 08-13, 9-16-2008)
